The National Lottery Commission, in exercise of the powers conferred on it by Sections 5 and 6 of the National Lottery etc. Act 1993 as amended by the National Lottery Act 1998, has granted to Camelot Group plc licences to run the National Lottery and to promote The National Lottery EuroMillions Game. The National Lottery EuroMillions Game Played Interactively is governed by the Interactive Account Terms and Conditions, the Rules for Draw-Based Games Played Interactively (available by calling the Interactive Contact Centre on 0845 278 8000 or by writing to the National Lottery, PO Box 1010, Liverpool L70 1NL or by accessing the National Lottery website with the following URL: www.national-lottery.co.uk) and these Procedures. In the event of any ambiguity or inconsistency between the Rules for Draw-Based Games Played Interactively and these Procedures, these Procedures shall prevail.
The National Lottery EuroMillions Game played otherwise than on the Interactive System is governed by the National Lottery Rules for Draw-Based Games and to the National Lottery EuroMillions Game Procedures.
Words and expressions defined in the Rules for Draw-Based Games Played
Interactively that are not defined in these Procedures shall bear the
same meaning herein unless the context otherwise requires.
Meaning of Words
The following words and terms, when used in these Procedures, shall have the following meanings, unless the context clearly indicates otherwise.
- 'Act'
- means the National Lottery etc. Act 1993 as amended by the National Lottery Act 1998.
- 'Board'
- means the area on an Interactive Play Slip in which an Interactive Player may enter his Selection to enter the UK Game.
- 'Cancelled Draw'
- means any draw which does not take place; or any Draw which takes place but in which the Playing Public cannot participate for any reason including, without limit, suspension of such participation as described in paragraph (J)(2) below and expiry, suspension or revocation of either the Company's licence from the Commission under Section 5 of the Act to run the National Lottery or the Company's licence from the Commission under Section 6 of the Act to promote the UK Game.
- 'Central Computer System'
- means the computer systems operated by, or on behalf of, the Company from time to time which facilitate the playing of, and contain a record of all selections made in relation to, the UK Game including, without limit, any Selections.
- 'Change Date'
- means 9th February 2007 (or, subject to the prior consent of the Commission, such later date as determined by the Company and the Co-Promoters, with not less than four weeks' prior written notice of such later date to be given by the Company to the Playing Public via, at the Company's discretion, the Site and/or the iDTV Interface and/or press notices).
- 'Commission'
- means the National Lottery Commission, being the body established to regulate the National Lottery or such other body as may carry out such functions from time to time.
- 'Common Prize Fund'
- means the prize fund for each Draw, as more particularly referred to in paragraph (F)(1) below.
- 'Company'
- means Camelot Group plc, a company registered in England and Wales, whose registered office is at Tolpits Lane, Watford, Hertfordshire WD18 9RN.
- 'Co-Promoter'
- means a body or organisation established in a territory outside the Territory which is licensed, authorised or otherwise permitted by the relevant authority to operate and promote a lottery forming part of the EuroMillions Game in a territory outside the Territory.
- 'Draw'
- means the process which culminates in the selection on a random basis and in accordance with the Draw Procedures of a set of Winning Numbers for all lotteries which form the EuroMillions Game.
- 'Draw Procedures'
- means the draw procedures to which any Draw shall be subject as determined by SLE from time to time.
- 'Entry'
- means a chance or entry in the UK Game.
- 'EuroMillions Game'
- means the EuroMillions Game as referred to in paragraph (B) below.
- 'Event Draw'
- means any Draw which is designated from time to time by the Company and the Co-Promoters, subject to the prior consent of the Commission, as a Draw in which (a) there will be a guarantee of the minimum amount which is available to pay prizes in the Match 5 and 2 Lucky Stars Prize Category, and (b) if there are no winners in that prize category, the prize money allocated to the Jackpot Pool for that Draw will be subject to the relevant rolldown procedure referred to in paragraph (F)(6)(b) below.
- 'Exchange Rate'
- means the Euro/Sterling exchange rate as notified by the Company's bankers, the Royal Bank of Scotland, to the Company from time to time and/or by such other financial institution as shall be agreed between the Company and the Commission from time to time.
- 'iDTV Interface'
- means the interface which is made available for Interactive Players to play the UK Game via interactive television channels.
- 'Interactive Play Slip'
- means the graphical representation of a play slip available on the Site and the iDTV Interface on which an Interactive Player may enter his Selection.
- 'Interactive Player'
- means a person who has opened a notional account on the Interactive System to enable that person to purchase Plays and who is eligible (according to the criteria set out in the Interactive Account Terms and Conditions) to purchase Plays within the Territory, and whose account has not been terminated, cancelled, suspended or closed.
- 'Interactive System'
- means the system (accessible via the Site or the iDTV Interface) established and operated by the Company for the purpose of registering prospective players, administering accounts, enabling Plays (including via a Mobile) and paying Prizes.
- 'Jackpot Category'
- means the Match 5 and 2 Lucky Stars Prize Category in the UK Game (as described in paragraph (E) below).
- 'Jackpot Pool'
- means the prize pool fund available to potential winners of the EuroMillions Game at the Match 5 and 2 Lucky Stars Prize Category as more particularly described in paragraph (F)(5) below.
- 'Jackpot Winner'
- means a winning Player at the Jackpot Category in the UK Game.
- 'Lottery Operators' Agreement'
- means the agreement between the Company, its Co-Promoters from time to time and SLE which provides for the operation and management of the EuroMillions Game, as the same may be amended from time to time.
- 'Lucky Dip'
- means a play consisting of one set of seven numbers (being five numbers in the Select Five Selection and two numbers in the Select Two Selection) which, instead of being selected by an Interactive Player, are selected on a random basis by the Company's Central Computer System on behalf of that player.
- 'Lucky Star Numbers'
- means the two numbers randomly selected as part of a Draw from the numbers one to nine inclusive only.
- 'Main Numbers'
- means the five numbers randomly selected as part of a Draw from the numbers one to fifty inclusive.
- 'Mobile'
- means a mobile phone that is capable of sending and receiving Short Messages, which is registered on one of the Mobile Networks and which has been registered on the Interactive System either via the Site or the Interactive Contact Centre.
- 'Mobile Network'
- means any UK mobile phone network that is capable of delivering Short Messages.
- 'Mobile Request'
- means a Player's request for a Selection to be entered into a Draw contained in a Short Message.
- 'Multi-draw'
- means a facility to play the UK Game for a number of Draws (such number not to exceed four Draws) using the same Selection(s), the number and frequency of such Draws being available for selection by Interactive Players in advance.
- 'Play'
- means an Entry in accordance with the Play Style for that game.
- 'Play Style'
- means the method of participation in the UK Game by an Interactive Player via the Interactive System as specified in these Procedures.
- 'Player'
- means a member of the Playing Public who purchases or otherwise acquires an Entry within the Territory, including an Interactive Player who purchases or otherwise acquires a Play.
- 'Playing Public'
- means members of the public who are eligible to purchase Entries within the Territory.
- 'Pools Fund'
- means the balance remaining in the Common Prize Fund after deduction from that fund of 38% of the monies in that fund for payment of the Jackpot Pool and payment into the Reserve Fund.
- 'Prize'
- means a prize won by a Player in the UK Game.
- 'Prize Category'
- means the prize categories set out in column (a) of the table forming part of paragraph (H)(1) below.
- 'Reserve Fund'
- means the fund described in Paragraph (G) below.
- 'Rules'
- means the Rules for Draw-Based Games Played Interactively as published by the Company and in force from time to time, subject to paragraph (M) below.
- 'Select Five Selection'
- means the five numbers selected by an Interactive Player from between the numbers one to fifty inclusive.
- 'Select Two Selection'
- means the two numbers selected by an Interactive Player from between the numbers one to nine inclusive only.
- 'Selection'
- means the set of seven numbers chosen by an Interactive Player, being five numbers in the Select Five Selection and two numbers in the Select Two Selection (or, in the case of a Lucky Dip, selected by the Company's Central Computer System on behalf of that Interactive Player).
- 'Short Message'
- means a message containing numerical or text characters or both, either sent or received using a Mobile.
- 'Site'
- means the website with the URL www.national-lottery.co.uk.
- 'SLE'
- means Services Aux Loteries En Europe, a société coopérative à responsibilité limitée incorporated in Belgium for the purposes of coordinating and organising the implementation and operation of the EuroMillions Game.
- 'Territory'
- means the United Kingdom and Isle of Man.
- 'Territory Pools Fund'
- means the notional fund available to the Company to satisfy Prizes won by Players in Prize Categories 2) through to 12) in paragraph (H)(1) below.
- 'UK Game'
- means a lottery known as "EuroMillions", which is licensed to the Company by the Commission under section 6 of the Act and which is promoted and operated by the Company in the Territory.
- 'Winning Numbers'
- means the numbers set out in the results of a Draw as issued by SLE and used to determine the winning entries in the EuroMillions Game.
- 'Winning Selection'
- means a selection of numbers which entitles a player who has lawfully and validly been issued with a ticket or other proof of entry for a Draw by or on behalf of the Company or a Co-Promoter to a prize in the category applicable to the correct numbers selected.
Where the context so requires in these Procedures, the neuter gender shall include the feminine or masculine gender and vice-versa, the feminine gender shall include the masculine gender and vice-versa and the singular shall include the plural and vice-versa.
(A) The Game
The UK Game is called 'EuroMillions'.
(B) The Euromillions Game
The Company and each Co-Promoter is authorised by the relevant authorities in the territory or territories in which it operates to operate and promote independent lotteries under the name or style of 'EuroMillions' or its translated equivalent, such lotteries together having a shared prize fund, a common Draw and a common game mechanic. Such lotteries are collectively known as the "EuroMillions Game".
(C) Draw
The Draw for the EuroMillions Game will take place once per week on Friday or such other day or days as may be specified by the Company and Co-Promoters. The Winning Numbers in respect of a Draw shall be finally and conclusively determined by SLE.
(D) Method of Playing the UK Game
(1) Cost of Entry
- (a) The Company will regularly review the price per Entry against the Exchange Rate to check whether or not the then current price per Entry reasonably approximates in the Company's view to the equivalent in pounds sterling of two Euros. If it does not then the Company shall be entitled, by not less than four weeks' prior written notice given to the Playing Public via, at its discretion, the Site and/or the iDTV Interface and/or press notices to increase or decrease (as appropriate) the price per Entry to that which, in the Company's opinion, will at the end of that four week period be likely to reasonably approximate to an Entry price of two Euros.
- (b) Any decreases or increases in the Entry price shall be in multiples of 10 pence or such other multiples as the Company shall in its discretion determine from time to time.
- (c) The cost of a Play for a Multi-draw will be the total cost of the Selections selected at the date of purchase multiplied by the number of Draws the Interactive Player has chosen.
- (d) A Play for a Multi-draw cannot be purchased for a number of Draws which includes a future Draw or Draws in respect of which the Company has given notice of an Entry price increase or decrease (as appropriate) under paragraph (D)(1)(a) above but which has yet to take effect.
(2) Making a Selection
If a Selection is not shown on the "My Account" section of the Site or the "My Lottery Account" section of the iDTV Interface, then that Selection will not have been entered into any Draw.
(i) Making a Selection via the Site or the iDTV Interface
- (a) On any one Interactive Play Slip an Interactive Player may complete a minimum of one Board and a maximum of the number of Boards included on the Interactive Play Slip.
- (b) Each Interactive Play Slip shall be completed in accordance with the instructions set out on the Site or on the iDTV interface.
- (c) Once an Interactive Player has entered his Selection(s) on the Site or on the iDTV Interface, he will be asked to confirm and accept the Selection(s) that is/are displayed on the "Confirm Play Slip" screen of the Site or on the iDTV Interface. Once the Interactive Player has done so, the Selection(s) will be entered into the relevant Draw and the Interactive Player will not be able to cancel the relevant Play.
- (d) By selecting the appropriate number under the words "Choose number of weeks" on an Interactive Play Slip, the Interactive Player will be able (subject to paragraph (D)(1)(d) above) to determine the number of weeks (up to a maximum of four) for which his Selection(s) will be entered into a Draw.
- (e) For the purposes of the number of weeks boxes on the Interactive Play Slip, the first week shall be a period commencing with the first available Draw as selected by the Interactive Player and ending immediately prior to and excluding the Draw on the same day of the following calendar week, the next week shall commence on the day of and from and including the Draw immediately prior to which the first week ended and shall end immediately prior to and excluding the Draw on the same day of the next calendar week, and subsequent weeks shall be similarly determined.
(ii) Making a Selection via a Mobile
- (a) In any one Mobile Request an Interactive Player may submit a minimum of one Selection and a maximum of four Selections.
- (b) Each Mobile Request shall be submitted in accordance with the instructions set out on the 'How to play' page of the 'Play by text' section of the Site.
- (c) Once an Interactive Player has submitted his Mobile Request and such request has been received by the Company, he will be sent a Short Message from the Company.
- (d) An Interactive Player will only be able to submit a Mobile Request for the next Draw.
- (e) For the avoidance of doubt, an additional charge, payable to the Player's Mobile Network operator, will be incurred when a Player purchases Plays via his Mobile.
(3) Play purchase
Entry into the National Lottery EuroMillions Game Played Interactively shall only be by way of purchase of a Play via the Site, the iDTV Interface or via a Mobile Request.
(4) Cancellation of a Play
- (a) Once an Interactive Player who is making the Selection(s) via the Site or the iDTV Interface has confirmed and accepted the Selection(s) that is/are displayed on the "Confirm Play Slip" screen of the Site or the iDTV Interface, unless that Play contains two or more Lucky Dip selections each comprising the same seven numbers (in which case paragraph (D)(4)(b) will apply), the Interactive Player will not be able to cancel the relevant Play.
- (b) An Interactive Player may cancel a Play which contains two or more Lucky Dip selections each comprising the same seven numbers if he telephones the Interactive Contact Centre within 120 minutes of the time he purchased the relevant Play or (where the Play is purchased on the day of a Draw and is eligible for that Draw) prior to the close of sales for that Draw, whichever is the earlier.
- (c) On cancellation of a Play the Interactive Player will be entitled to a refund equal to the price of the Play, which refund will be placed directly into an Interactive Player's Account.
(5) Payment of Prizes
Subject to the provisions of the applicable game rules and game procedures for the UK Game, the Company will only pay out a prize in the UK Game in respect of an Entry and, for the avoidance of doubt:
- (a) the Company will not pay out a prize in respect of any ticket or entry for a lottery forming part of the EuroMillions Game issued by or on behalf of a Co-Promoter;
- (b) a Player may claim a Prize from the Company only (and not any Co-Promoter or SLE); and
- (c) neither any Co-Promoter nor SLE is responsible for satisfying any claim for a prize made by a Player in respect of an Entry.
(E) Winning Selections in the UK Game
Subject to the provisions of the applicable game rules and game procedures for the UK Game, a Player who, in respect of any selection, has two or more numbers from or in the Select Five Section which match the Main Numbers drawn in a Draw and one or both numbers from or in the Select Two Section which match one or both of the Lucky Star Numbers drawn in that Draw will be entitled to a prize in the highest prize category to which those numbers relate.
- 'Match 5 and 2 Lucky Stars' category:
- means that the five numbers selected by a Player from or in the Select Five Selection ("the Select 5 numbers") match, in any order, all the Main Numbers drawn in a Draw and the two numbers selected by a Player from or in the Select Two Selection ("the Select 2 numbers") match, in any order, the Lucky Star Numbers drawn in that Draw.
- 'Match 5 and 1 Lucky Star' category:
- means that the Select 5 numbers match, in any order, all the Main Numbers drawn in a Draw and one only of the Select 2 numbers matches the Lucky Star Numbers drawn in that Draw.
- 'Match 5' category:
- means that the Select 5 numbers match, in any order, all the Main Numbers drawn.
- 'Match 4 and 2 Lucky Stars' category:
- means that four of the Select 5 numbers match, in any order, the Main Numbers drawn in a Draw and the Select 2 numbers match, in any order, the Lucky Star Numbers drawn in that Draw.
- 'Match 4 and 1 Lucky Star' category:
- means that four of the Select 5 numbers match, in any order, the Main Numbers drawn in a Draw and one only of the Select 2 numbers matches the Lucky Star Numbers drawn in that Draw.
- 'Match 4' category:
- means that four of the Select 5 numbers match, in any order, the Main Numbers drawn.
- 'Match 3 and 2 Lucky Stars' category:
- means that three of the Select 5 numbers match, in any order, the Main Numbers drawn in a Draw and the Select 2 numbers match, in any order, the Lucky Star Numbers drawn in that Draw.
- 'Match 3 and 1 Lucky Star' category:
- means that three of the Select 5 numbers match, in any order, the Main Numbers drawn in a Draw and one only of the Select 2 numbers matches the Lucky Star Numbers drawn in that Draw.
- 'Match 2 and 2 Lucky Stars' category:
- means that two of the Select 5 numbers match, in any order, the Main Numbers drawn in a Draw and the Select 2 numbers match, in any order, the Lucky Star Numbers drawn in that Draw.
- 'Match 3' category:
- means that three of the Select 5 numbers match, in any order, the Main Numbers drawn.
- 'Match 1 and 2 Lucky Stars' category:
- means that one of the Select 5 numbers matches the Main Numbers drawn in a Draw and the Select 2 numbers match, in any order, the Lucky Star Numbers drawn in that Draw.
- 'Match 2 and 1 Lucky Star' category:
- means that two of the Select 5 numbers match, in any order, the Main Numbers drawn in a Draw and one only of the Select 2 numbers matches the Lucky Star Numbers drawn in that Draw.
(F) Prize Fund/Prize Pools in the EuroMillions Game for a Draw
- (1) The prize fund for determining prize(s) for a Draw ("Common Prize Fund") shall comprise either one euro per entry in that Draw or such larger amount as shall be calculated by reference to any scheme that has the Commission's prior approval.
- (2) The amount from the value of sales of Entries allocated to the Common Prize Fund by the Company under paragraph (F)(1) above shall be 50% of the value of such sales for the relevant Draw, converted into Euros at the Exchange Rate current at the Draw date and adjusted in accordance with paragraphs (F)(3) and (4) below.
- (3) For each Draw, the Company will calculate the difference between (a) one Euro converted into pounds sterling at the Exchange Rate current on the Draw date multiplied by the number of Entries for that Draw and (b) one-half of the value of sales of Entries in Sterling for that Draw multiplied as aforesaid. If (a) exceeds (b) then an amount equal to the difference will be added to the amount allocated to the Common Prize Fund from the value of sales of Entries. If (b) exceeds (a) then an amount equal to the difference will be deducted from the amount allocated to the Common Prize Fund from the value of sales of Entries.
- (4) Any amount deducted from the allocation as referred to in paragraph (F)(3) above in respect of a Draw shall be added to the Territory Pools Fund and any amount added to such allocation shall be deducted from the Territory Pools Fund to increase or reduce as applicable the funds available to each Prize Category (excluding for the avoidance of doubt the Jackpot Category) in the same proportion which the amount of the Prizes payable to Players in one Prize Category (excluding the Jackpot Category) bears to the amount of the total Prizes payable to Players in all Prize Categories (excluding the Jackpot Category) for that Draw.
- (5)
- (a) In respect of all Draws due to take place before the Change Date:
- (i) an amount equal to 22% of the Common Prize Fund shall be deducted from the Common Prize Fund and shall, together with any monies added to that amount under paragraphs (F)(6)(a) and/or (F)(6)(b) and/or (F)(6)(c) and/or (G) below, comprise the prize pool for the Match 5 and 2 Lucky Stars Prize category for the EuroMillions Game for that Draw ("the Jackpot Pool"); and
- (ii) a further amount, equal to 16% of the Common Prize Fund, shall be deducted from the Common Prize Fund and shall be applied to the Reserve Fund in accordance with paragraph (G) below.
- (b) In respect of all Draws due to take place on or after the Change Date:
- (i) paragraph (F)(5)(a)(i) shall have effect but the percentage shall be 32% instead of 22%; and
- (ii) paragraph (F)(5)(a)(ii) shall have effect but the percentage shall be 6% instead of 16%.
- (a) In respect of all Draws due to take place before the Change Date:

- (a) If in any Draw, there are no winners in the Match 5 and 2 Lucky Stars Prize Category in the EuroMillions Game, then subject to paragraph (F)(6)(b) below the relevant Jackpot Pool for that Draw will be allocated to the Jackpot Pool for the next Draw.
- (b)
- (i) In respect of all Draws which are due to take place before the Change Date, on the twelfth consecutive Draw in which there are no winners in the Match 5 and 2 Lucky Stars Prize Category in the EuroMillions Game, then the prize money allocated to the relevant Jackpot Pool for that twelfth Draw will be allocated to the next lower Prize Category for that same twelfth Draw in which there is at least one winner ("Rolldown Procedure"). If there are no winners in any Prize Category the relevant Jackpot Pool will be allocated to the Match 5 and 2 Lucky Stars Prize Category for the next Draw and if there are no winners in the Match 5 and 2 Lucky Stars Prize Category in that next Draw the Rolldown Procedure will be applied again.
- (ii) In respect of all Draws which are due to take place on or after the Change Date, on the eleventh consecutive Draw (or, if earlier, any Event Draw) in which there are no winners in the Match 5 and 2 Lucky Stars Prize Category in the EuroMillions Game, then the prize money allocated to the relevant Jackpot Pool for that Draw will be allocated to the next lower Prize Category for that Draw in which there is at least one winner. ("New Rolldown Procedure"). If there are no winners in any Prize Category for that Draw the relevant Jackpot Pool will be allocated to the Match 5 and 2 Lucky Stars Prize Category for the next Draw and if there are no winners in the Match 5 and 2 Lucky Stars Prize Category in that next Draw the New Rolldown Procedure will be applied again. For the avoidance of doubt, the eleventh consecutive Draw in a Draw series can be an Event Draw.
- (iii) Once the Rolldown Procedure or, as the case may be, the New Rolldown Procedure has been applied, the next Draw will be the first in the next Draw series.
- (c) If in any Prize Category (other than the Match 5 and 2 Lucky Stars Prize Category) there are no winners in that Prize Category in the EuroMillions Game, the prize money allocated to that category will be allocated to the next lower Prize Category (if any) for that Draw in which there is at least one winner or, if there is no such next lower Prize Category, to the Jackpot Pool for the next Draw.
- (d) Prize money allocated to a Prize Category will be divided equally by the number of winners in that Prize Category and the relevant proportions shall be attributed to the Territory Pools Fund and the prize fund for the Jackpot Category accordingly.
(G) Reserve Fund
- (1) The Reserve Fund is common to the Company and the Co-Promoters.
- (2)
- (a) Amounts allocated to the Reserve Fund may only be used as stated in paragraph (G)(2)(b) below.
- (b) All or part of the sums allocated to the Reserve Fund may, as agreed from time to time by the Company and the Co-Promoters, be used to supplement the monies available for the Jackpot Pool for any Draw, subject to the prior consent of the Commission where it is proposed that the amount of such supplement shall cause the Jackpot Fund to exceed a certain level as agreed from time to time between the Company and the Commission.
(H) Approximate Odds of Winning, and Prize Structure in the EuroMillions Game
(1) The following table sets forth for any Draw the probability of winning and the proportion of the Common Prize Fund available at each Prize Category.

(I) Determination of Prizes for Players in the UK Game
- (1) The holder of a winning Entry may win in only one Prize Category per Entry in connection with the Winning Numbers drawn in each Draw and shall be entitled only to the prize for the highest Prize Category won by those numbers in each Draw (regardless of the actual Prize value).
- (2) The prize fund available to Jackpot Winner(s) shall be the Jackpot Pool divided by the total number of Winning Selections at that Prize Category and multiplied by the number of Jackpot Winner(s).
- (3) The prize fund in paragraph (I)(2) above shall be divided equally between the number of Jackpot Winners.
- (4) The relevant proportion of the Territory Pools Fund applicable to each Prize Category shall be the amount calculated in accordance with column (c) of paragraph (H) (1) above available for that Prize Category divided by the total number of Winning Selections at that Prize Category and multiplied by the number of winning Players in the same Category and adjusted in accordance with the provisions of paragraphs (F)(3) and (F)(4) above.
- (5) The adjusted proportion of the Territory Pools Funds allocated to a Prize Category in paragraph (I)(4) above shall be divided equally by the number of winning Players in that Prize Category.
- (6) All Prizes shall be paid by the Company in pounds sterling. For the purposes of such payments (a) the amount payable to Jackpot Winners and (b) the amount attributed to the Territory Pools Fund from the Common Prize Fund shall be converted from euros into pounds sterling using the Exchange Rate applicable as at the date of a Draw.
- (7) All Prizes will be rounded down to the nearest 10 pence.
(J) Trust Arrangements/Suspension of Participation
- (1) To secure their respective obligations to transfer funds to the Company and/or a Co-Promoter to facilitate the payment of prizes by the Company and/or that Co-Promoter, the Company and the Co-Promoters have agreed to the establishment of various trust accounts in the United Kingdom and have agreed various arrangements in respect of the operation of such accounts (the "Trust Arrangements").
- (2) In the event of any breach by the Company or a Co-Promoter of the Trust Arrangements or of the Lottery Operators' Agreement, the participation in future Draws of persons in the territory of the Company or that Co-Promoter may be suspended for such period as those of the Company and Co-Promoter not being in such breach (and the Commission if the Company is in such breach) shall determine in accordance with the Trust Arrangements and/or the Lottery Operators' Agreement.
(K) Refunds in Certain Circumstances
- (1) Notwithstanding Rule 5(D)(5) of the Rules, in the event of a Cancelled Draw the Company shall refund to an Interactive Player who has purchased either a Play for the Cancelled Draw only or a Play for a Multi-draw for the Cancelled Draw and other Draws, an amount equal to that part of the purchase price as was paid in respect of and is attributable to the Cancelled Draw.
- (2) Any refund and payment under paragraph (K)(1) above will be placed directly into an Interactive Player's Account and this shall be the Company's only liability to an Interactive Player in such circumstances.
- (3) The Company shall in no circumstances be liable to pay interest in respect of refunds or payments made under this paragraph (K).
- (4) For the avoidance of doubt, this paragraph shall not apply in respect of any Draw which is delayed or postponed nor in respect of any Draw which is cancelled but which is not a Cancelled Draw as defined in these Procedures.
(L) Liability
- (1) The Company shall not, in any circumstances, have any liability of
whatever nature to any person to the extent that he plays the EuroMillions
Game via a Co-Promoter or such Co-Promoter's agents. In particular, but
without limitation, where the Company does not for any reason participate
in any Draw, the Company shall not be liable to such person in respect
of any such non-participation including, but without limitation:
- (a) any failure by the Company to contribute to the Common Prize Fund in respect of such Draw and any consequent reduction in any prize which would otherwise have been due to such person from any Co-Promoter; or
- (b) any special, indirect or consequential loss suffered by such person.
- (2) If a Co-Promoter does not for any reason participate in any Draw
the Company shall not, in any circumstances, have any liability of whatever
nature to:
- (a) any Player; nor
- (b) any other person to the extent that he plays the EuroMillions Game
via a Co-Promoter or such Co-Promoter's agents,
in respect of any such non-participation including, but without limitation:
- (i) any failure by such Co-Promoter to contribute to the Common Prize Fund in respect of such Draw and any consequent reduction in any Prize which would otherwise have been due to any Player from the Company; or
- (ii) any special, indirect or consequential loss suffered by such person or Player.
(M) The Rules
The 'Rules' shall apply to the promotion and operation of the sale of Plays in the UK Game by the Company subject to the following:
- (1) The words 'and as recorded in writing by a witness' are deemed to be deleted from Rule 4(E)(4).
- (2) The words 'and in any event subject to a maximum delay of 24 hours' are deemed to be added at the end of Rule 4(E)(7).
- (3) The second sentence of Rule 4(E)(9) is deemed to be deleted.
- (4) The words 'and, where appropriate, the relevant exchange rate' are deemed to be added at the end of Rule 4(F)(2)(d).
- (5) The following words are deemed to be added at the end of Rule 5(D)(5):
'(g) for any errors or omissions in information in respect of the EuroMillions Game (and including any Draw) supplied to the Company by SLE or any Co-Promoter (both as defined in the Game Procedures for the UK lottery known as EuroMillions Played Interactively).'
