  • 4. Registration

    • (A) Registration

      • (1) Criteria for Registration

        A person intending to become a Player (an "Intending Player") may not open an Account unless located in the United Kingdom or Isle of Man at the time of applying for registration, and unless and until the following criteria are satisfied:-

        • (e) the card referred to in (d) above has not been reported as lost or stolen or has not been supplied in relation to another Account; and
        • (f) where required the Intending Player is able to verify the authenticity of any information he has supplied to the Company by a method to be determined by the Company in its sole discretion.

        The Company reserves the right to refuse to complete Full Registration or Try Game Registration for any Intending Player for any reason in its absolute discretion.

        The Company reserves the right to carry out checks or request information from Players or Prospective Players from time to time during or after registration to check that the Player or Prospective Player and/or his debit card (where debit card details are supplied) meet the criteria set out in this Clause 4(A)(1).

      • (9) Players may obtain Play Cards from certain Retailers who are permitted by the Company to issue Play Cards from time to time, by the following methods:
        • (a) presenting a completed Play Slip to such a Retailer;
        • (b) indicating the Game and the requisite numbers which are to be reproduced on the Play Card, to be entered manually into the Terminal (other than a Till-point Terminal) by such a Retailer; or
        • (c) indicating that the Play Card should, in the event that the Player wishes to purchase an Entry by way of that Play Card, result in one or more Lucky Dip Entries being generated.
      • (10) Play Cards are provided for the convenience of Players, and shall have no monetary or Prize value nor will they constitute evidence of an Entry or of the numbers selected. Except in the case of an Entry by Offline Direct Debit and subject to the provisions of Rule 4(P) below, a Valid Winning Ticket shall be the only valid basis for claiming a Prize.
      • (11) Play Cards are issued by, and remain the property of, the Company, who reserves the right to decline the issue or use of, or to withdraw any Play Card at any time (including, without limitation, when issued to or in the possession of any person falling within any of the categories of persons set out in Rule 4(I)(1)), or to alter or amend the operation of the Play Card scheme, or to terminate the scheme at any time without notice.
      • 12) A Player using a Play Card to purchase a Ticket should submit the Play Card to a Retailer together with the appropriate amount due. The Play Card will then be processed through a Terminal by the Retailer, and the relevant Ticket will be issued only through that same Terminal.
      • (13) If the Play Card is rejected by the Terminal there is no valid Entry.
      • (14) If a Play Card is processed through a Till-point Terminal but a Ticketless Entry occurs which is not cancelled in accordance with Rule 4(G), Rule 4(P) will apply.
      • (15) Play Cards cannot be issued by Till-point Terminals.
    • (D) Multi-Draws

      • (1) Where a Player is permitted to and uses the Multi-draw facility to purchase a Ticket, he will mark his Selection on the appropriate Boards of the Play Slip, mark the appropriate box under the words "Choose which draw" on the Play Slip to determine the frequency of the Draws for which his Selection is to be entered, and mark the appropriate number of weeks box. Alternatively, the Player, at a Terminal other than a Till-point Terminal, may request the Retailer to manually enter the number and frequency of Draws. The Terminal will issue a Ticket which shows the Entry made, the number and frequency of Draws selected and the range of Draw dates for which the Ticket is valid.
      • (2) Where a Player is permitted to and uses the Multi-draw facility to obtain a Play Card, he will mark his Play Card Selection on the appropriate Boards of the Play Slip, mark the appropriate box under the words "Choose which draw" on the Play Slip to determine the frequency of the Draws for which his Play Card Selection is to be entered (at the time he uses the Play Card to purchase a Ticket) and mark the appropriate number of weeks box. Alternatively the Player may, at a Terminal other than a Till-point Terminal, request the Retailer to manually enter the number and frequency of Draws into which he wishes his Play Card Selection to be entered (at the time he uses his Play Card to purchase a Ticket).
      • (3) For the purposes of the number of weeks boxes on a Play Slip, the first week shall be a period commencing with the first next available Draw for that Game as selected by the Player and ending immediately prior to and excluding the Draw on the same day of the following calendar week (the "Second Week Draw Day"), the next week shall commence on the Second Week Draw Day and include the Draw on such Second Week Draw Day and shall end immediately prior to and excluding the Draw on the same day of the next calendar week, and subsequent weeks shall be similarly determined.
      • (4) If a Prize is paid on a Multi-draw Ticket which is still valid for future Draws, an Exchange Ticket will be issued, in accordance with the Company's procedures, to the owner or claimant together with his Prize payment.
      • (5) A Multi-draw Ticket shall not be capable of cancellation other than in accordance with Rule 4(G)(1) below and, in any event, prior to the first Draw in respect of which the Ticket has been issued.
      • (6) No Exchange Ticket or Voucher Ticket will be cancelled.
    • (E) Playing by Offline Direct Debit

      • (1) In addition to purchasing Tickets from Retailers some Draw-Based Games will be available via an Offline Direct Debit. Each Offline Direct Debit shall be sold by the Company for the retail sale price advised by the Company from time to time. An Applicant can apply to play some Draw-Based Games by Offline Direct Debit by:

        • (a) completing the necessary details on the relevant application form and submitting such form, with the required payment authority, to the Company at the designated address specified from time to time; or
        • (b) submitting such details as are required by the Company and payment authority by telephone.

        If an Applicant applying in accordance with Rule 4(E)(1)(a) above is unable to provide any of the details above due to legal, physical or other disability, a duly authorised representative of the Applicant may provide the requisite details and if required, sign the relevant documents on his behalf. The representative must state the name of the Applicant and the representative and describe the status of the signatory, if not the Applicant. The Company reserves the right to establish such representative's entitlement to act on behalf of the Applicant in applying for the Offline Direct Debit and if applicable, managing the Offline Direct Debit on the Applicant's behalf.

        The Applicant must be located in the UK or Isle of Man at the time of submitting the application form, payment authority and required details.

      • (2) Offline Direct Debit may be for a rolling term only and shall continue until terminated by the Offline Direct Debit Player by the giving of at least 3 weeks' notice in writing to the address detailed in Rule 4(E)(16) or by such other method as the Company may permit from time to time.
      • (3) Payment can be made by such method as the Company shall permit in respect of the Offline Direct Debit applied for. Such payment method may include payment by direct debit which must be made payable to the Company or to such other person as the Company shall direct, or by such other method as the Company shall with the consent of the Commission permit from time to time.
      • (4) The criteria in paragraphs (a) - (d) below must be satisfied before the Offline Direct Debit can commence:
        • (a) the Applicant must have an address in the UK or Isle of Man of which particulars have been given to, and at which they are recognised by checks carried out by, the Company, from which the application is made (whether in relation to the initial Offline Direct Debit or a renewal of the Offline Direct Debit);
        • (b) the Applicant must not be a Minor;
        • (c) the Applicant must hold a UK or Isle of Man bank account or a UK or Isle of Man building society account out of which payment for the Offline Direct Debit shall be made; and
        • (d) the Applicant may not be in one of the categories of people referred to in Rule 4(I)(1).
        • Thereafter, the criteria in paragraphs (e), (f) and (g) below must continue to be satisfied at all times during the Offline Direct Debit;
        • (e) the Offline Direct Debit Player must continue to have an address in the UK or Isle of Man of which particulars have been given to, and at which they are recognised by checks carried out by, the Company, and the Offline Direct Debit Player may only amend or attempt to amend the details of any Draw-Based Game played by him by way of Offline Direct Debit whilst located in the UK or the Isle of Man;
        • (f) the Offline Direct Debit Player must continue to hold a UK or Isle of Man bank account or a UK or Isle of Man building society account out of which payment for the Offline Direct Debit shall be made. The Offline Direct Debit Player may change his Offline Direct Debit details (including without limitation the bank name, and account number) only whilst located in the UK or Isle of Man;
        • (g) the Offline Direct Debit Player may not be in one of the categories of people referred to in Rule 4(I)(1).
      • (5) The Applicant will be required to supply certain information to the Company during the Offline Direct Debit application process which will assist the Company (i) in determining whether or not the Applicant meets the criteria set out above and (ii) to verify the Applicant's eligibility to play the Games. This information will include but will not be limited to the Applicant's name, address details, date of birth, gender, email address and payment details. The Company further reserves the right to request an authentication agency to verify such information relating to the Applicant. If the Company is not satisfied that the information provided (i) is adequate and/or (ii) has been verified by the Company or any authentication agency, then the Company may refuse an application for an Offline Direct Debit in its absolute discretion.
      • (6) The Company may be required to share personal information it obtains about the Applicant, while processing his application for an Offline Direct Debit, or about the Offline Direct Debit Player during the period that the Offline Direct Debit is effective or at any time, with the Commission. The Company may also share this information with third parties in order to process the Applicant's application for Offline Direct Debit and to manage the Offline Direct Debit once processed. If the Applicant has provided the Company with direct debit details, the Company and on its behalf, third parties may undertake checks to ensure he is entitled to authorise that direct debit and that he has sufficient funds to play the Draw-Based Games he has chosen to play.
      • (7) If any Applicant fails to satisfy any authentication procedures implemented by the Company or on its behalf by any third party, then the Company may (but shall not be obliged to) offer alternative authentication procedures for the Applicant to comply with.
      • (8) The Company may in its absolute discretion refuse to accept an application for an Offline Direct Debit. Upon acceptance by the Company of a completed Offline Direct Debit application following the Company's processing of that application, the Company will produce and send, at the Offline Direct Debit Player's risk to the address provided in such application an Offline Direct Debit Confirmation which will give details of the Offline Direct Debit as registered in the Central Computer System (including an identifying Offline Direct Debit number).
      • (9) An Offline Direct Debit Player's number selection(s) contained in an Offline Direct Debit will not be entered into a Draw and the Offline Direct Debit Player shall not be entitled to any Prize for that Draw in respect of such selection(s) where the Offline Direct Debit Player's payment, as the case may be, has not been received by the Company at least 48 hours (or such other time period prescribed by the Company) before the relevant Draw.
      • (10) Subject to Rule 4(E)(11) an Offline Direct Debit or part thereof shall be void and shall not in any case entitle its holder to a Prize if:
        • (a) the Company has not received the payment required by it for that Offline Direct Debit or the relevant part of the Offline Direct Debit by 48 hours (or such other time period prescribed by the Company) before the date on which the Offline Direct Debit or the relevant part of the Offline Direct Debit would have, but for such non-payment, become an Offline Direct Debit or relevant part of the Offline Direct Debit containing numbers which match the Winning Numbers; or
        • (b) the relevant Player no longer meets the criteria set out in paragraphs (e), (f) and (g) of Rule 4(E)(4) above.
      • (11) The Company reserves the right to delay the commencement of an Offline Direct Debit or suspend the Offline Direct Debit or relevant part of the Offline Direct Debit when the relevant payment is not received within the period referred to in Rule 4(E)(10).
      • (12) The Offline Direct Debit Player will be responsible for ensuring the Offline Direct Debit Confirmation correctly shows the number of number selection(s) and the numbers relevant to those selection(s) selected by him, the Game(s) for which he has been entered and the frequency and commencement of the date of the Draws. In the event that the Offline Direct Debit Player considers that the Offline Direct Debit Confirmation does not show the correct information, he shall notify the Company of which details are incorrect as soon as reasonably practicable, and in any event within the timescales prescribed by the Company. The Company shall not be responsible for any errors or omissions in respect of any data recorded on any Offline Direct Debit Confirmation or for any loss of whatever nature suffered or incurred by any person as a result of any such errors or omissions affecting an Offline Direct Debit Confirmation.
      • (13) Number selections contained in an Offline Direct Debit Confirmation may only be changed with the prior consent, in every case, of the Company.
      • (14) Subject to the provisions of Rules 4(E)(10) and (17), an Offline Direct Debit shall commence on the date of the first Draw recorded on the Offline Direct Debit Confirmation.
      • (15) Except as hereinafter provided, the Offline Direct Debit Confirmation shall confirm that, for the recorded Game(s) and Draws of the recorded frequency held by the Company from and including the starting date shown therein the Offline Direct Debit Player is deemed to have purchased each of the number selections indicated by the Offline Direct Debit Confirmation.
      • (16) In the case of Offline Direct Debits made by postal application, notification of any change of the name and address of any Offline Direct Debit Player must be made in writing or by such other method as the Company may permit from time to time and subject to Rule 4(E)(1) signed by the Offline Direct Debit Player, providing details of the change and including the Offline Direct Debit number. The notification should be sent to The National Lottery Offline Direct Debit Department, P O Box 251, Watford, Hertfordshire WD18 9RD or such other address advised by the Company. In the case of Offline Direct Debits made by telephone, changes may be notified by telephone to the appropriate dedicated telephone line upon proof of identity being provided.
      • (17) In the event of a conflict or discrepancy between the information (including the numbers) contained in the Offline Direct Debit Confirmation and the information contained in the Central Computer System, the information registered in the Central Computer System shall prevail and in particular only the numbers registered in the Central Computer System shall participate in the Draws on the Draw dates registered in the Central Computer System.
      • (18) The liability of the Company for any loss of whatever nature suffered or incurred by an Offline Direct Debit Player as a result of any such conflict or discrepancy whether or not the same was caused by an act or omission of the Company, its employees, retailers, co-promoters or other third parties and, whether in negligence or otherwise, is limited to the amount of the Offline Direct Debit monies paid for the relevant Offline Direct Debit Player's Entry for which loss has been suffered, as the case may be.
      • (19)
        • (a) Prizes of less than £5,000 in respect of an Offline Direct Debit will be paid by the Company by, at its discretion, cheque or direct credit. If a direct debit is established on a joint account, that will constitute the Offline Direct Debit Player's authority to the Company at its discretion to pay any such Prize by direct credit into the account, notwithstanding that such payment may amount to disclosure of the Prize to the other holders of that account.
        • (b) Prizes of £5,000 or more and up to and including £50,000 will be satisfied by cheque and will be sent by mail to, and at the risk of, the Offline Direct Debit Player in accordance with the Company's procedures.
      • (20) Prize winnings of over £50,000 must be claimed in person and will be payable by cheque, other approved instrument or direct credit at the option of the Company. The Company will contact the Offline Direct Debit Player and invite him to claim the Prize at the Offline Direct Debit Player's home, other agreed location or at a Regional Centre.
      • (21) Claimants may be required to present such identification as proof of entitlement to Prizes that the Company shall require (including, without limit, proof of identity and capacity to claim). The Company reserves the right to withhold payment of any Prize until it is entirely satisfied as to the validity of any Offline Direct Debit and the good faith of the Claimant. The Company reserves the right to photograph any Claimant for security purposes.
      • (22) The Company reserves the right to cancel, alter or modify at any time the whole or any part of the Draw-Based Game for which a Player has an Offline Direct Debit, including these Rules and the Game Procedures relating to that Game, and to cancel, alter or modify the whole or part of any Offline Direct Debit or any condition attaching to Offline Direct Debits to the extent necessary or appropriate to reflect any such cancellation, alteration or modification and to notify the Offline Direct Debit Player as the case may be, of such cancellation, alteration or modification of that Offline Direct Debit.
      • (23) Subject to Rule 4(E)(22), in the event of cancellation of a draw, the Company will extend the Offline Direct Debit to an appropriate alternative draw. In the event of the cancellation of an Offline Direct Debit (whether in whole or part) the Company will make a proportionate refund to the Offline Direct Debit Player.
      • (24) In the event of alteration or modification of a Draw-Based Game or a Draw, or of any conditions attaching to Offline Direct Debit, or of any cancellation of part of an Offline Direct Debit or of any other alteration or modification to an Offline Direct Debit the Company may cancel the existing Offline Direct Debit, issue a new Offline Direct Debit and send to the Offline Direct Debit Player an Offline Direct Debit Confirmation reflecting such cancellation, alteration or modification. The new Offline Direct Debit shall be effective from the first Draw date recorded on the Offline Direct Debit Confirmation.
      • (25) The Company, at its absolute discretion and without specifying any reason, may cancel an Offline Direct Debit or may partially cancel an Offline Direct Debit by removing one or more Game(s) from the Offline Direct Debit, with effect from the next draw(s) of the Game(s) to which that Offline Direct Debit (or the relevant part of the Offline Direct Debit) relates, and:
        • (a) in the event of a cancellation of an Offline Direct Debit as a whole the Company's only liability to the Offline Direct Debit Player shall be to repay to the Offline Direct Debit Player any monies previously paid in respect of that Offline Direct Debit for any Draw or Draws of the Game(s) to which the Offline Direct Debit relates occurring after such cancellation and to pay to the Offline Direct Debit Player any unpaid Prizes due to him in respect of Draws prior to such cancellation; or
        • (b) in the event of a partial cancellation of an Offline Direct Debit, the Company's only liability to the Offline Direct Debit Player shall be to repay to the Offline Direct Debit Player any monies previously paid which are attributable to the Draw(s) of the Game(s) which has/have been removed from the Offline Direct Debit but only in respect of the Draw(s) occurring after such partial cancellation and to pay to the Offline Direct Debit Player any unpaid Prizes due to him in respect of Draws of the Game(s) which has/have been removed from the Offline Direct Debit prior to such cancellation.
      • (26) On termination or cancellation of an Offline Direct Debit, the Company will return the Player's paid unutilised Offline Direct Debit monies to the bank (or building society) account, details of which are held by the Company in respect of that Player, or return the balance to the relevant Player by other appropriate means. In the event that the Company is not able to return the balance to the relevant bank (or building society) account or to the Player by other appropriate means, it will retain the balance for a period of six (6) years from the date the Offline Direct Debit was terminated after which time such balance will be allocated to the National Lottery Distribution Fund. A Player may contact the Company to claim the balance at any time during the six (6) year period during which the Company retains such balance. Subject to the Player providing such information as the Company shall reasonably require, the Company shall refund such balance.
      • (27) If a dispute arises between the Company and the Claimant as to whether an Offline Direct Debit is valid and the Prize claimed has not been paid, the Company may, solely at its option, reimburse the cost of the Entry or replace the disputed Entry with an Entry of equivalent sales price for any current Draw-Based Game. This shall be the Claimant's sole and exclusive remedy, and such reimbursement or replacement shall fully discharge the Company from any liability in respect of such dispute.
    • (F) Responsibility for Tickets and Play Cards

      Play Cards

      • (1) It shall be the sole responsibility of the Player, at the time of issue of a Play Card:
        • (a) to ensure that such Play Card is received by him;
        • (b) to verify that the Play Card Selection(s), the Games, the days and frequency of the Draws set out on the Play Card correspond with those marked on the Play Slip given to the Retailer by the Player or, if the Player has not used a Play Slip, that the Play Card Selection(s), the Games, the days and frequency of the Draws set out on the Play Card correspond with those specified by such Player to the Retailer; and
        • (c) to ensure that a clear bar code and legible associated serial number appear on the Play Card.

      Tickets

      • (2) It shall be the sole responsibility of the Player, at the time of issue of a Ticket:
        • (a) to ensure that such Ticket is issued to him;
        • (b) in the case of a Ticket issued from a Till-point Terminal, to verify that the Entry(ies), the Games, the dates and frequency of Draws set out on the Ticket correspond with those marked on the Play Card or, if the Player has requested one or more Lucky Dip Selections without using a Play Card, that the number of Lucky Dip Entry(ies), the Games, the dates and frequency of Draws set out on the Ticket correspond with those specified by such Player to the Retailer;
        • (c) in the case of a Ticket issued from a Terminal other than a Till-point Terminal to verify that Entry(ies), the Games, the dates and frequency of Draws set out on the Ticket correspond with those marked on the Play Slip or, if the Player has not used a Play Slip, that the Entry(ies), the Games, the dates and frequency of the Draws set out on the Ticket correspond with those specified by such Player to the Retailer; and
        • (d) to ensure that a legible Control Number (including, if any, a clear bar code) appears on the Ticket.
      • (3) Neither the Company nor any Retailer will be responsible for any loss of whatever nature suffered or incurred by any person as a result of any of the details and information set out in Rule 4(F)(1) above not appearing or appearing incorrectly on a Play Card or as a result of any of the details and information set out in Rule 4(F)(2) above not appearing or appearing incorrectly on a Ticket or as a result of a legible Control Number and/or bar code not appearing on the Ticket or as a result of a legible bar code not appearing on the Play Card.
      • (4) Subject to these Rules (including but without limitation the Ticket Validation Requirements and Rules 4(P) and 4(S)(8)):
        • (a) until such time as a name and address is placed on a Ticket, the holder of a Ticket which has been issued in accordance with the provisions of these Rules shall be the owner thereof for the purposes of these Rules;
        • (b) when a name and address is entered on a Ticket the person whose name and address appears there shall be the owner of that Ticket for the purposes of these Rules.
      • (5) After a Ticket has been issued the Player will be responsible for the safe custody and condition of that Ticket. Subject to Rule 4(P) and except in the case of Offline Direct Debit, failure to produce a Ticket on claiming a Prize will result in refusal to pay the prize. Without limitation, the Player must take particular care to ensure that any Ticket issued by a Terminal is protected from excessive heat, direct sunlight and contact with any grease, oils or plastics, and no Ticket should be kept in any plastic wallet supplied by any Retailer or the Company for the purposes of protecting a Play Card.
      • (6) Neither the Company nor any Retailer will be responsible for loss, theft, mutilation, destruction or degradation of any Ticket or Play Card or for any errors or omissions in respect of any data recorded on any Ticket or Play Card or for any loss of whatever nature suffered or incurred by any person as a result of any such event or condition affecting a Ticket or Play Card.

      • (8) The Player's eligibility to win a Prize is subject to the Ticket Validation Requirements.
    • (G) Cancellation of a Ticket or Ticketless Entry

      • (1) Subject to Rule 4(G)(2)(4) and (8) below, a Ticket (other than an Exchange Ticket to which the provisions of Rule 4(D)(5) above apply) may be cancelled if it has been issued in error; or it is illegible; or it is incomplete; or if it contains two or more Lucky Dip Selections each comprising the same numbers for the same Game.
      • (2) A Ticket falling within the terms of Rule 4(G)(1) above may only be cancelled if:
        • (a) it is returned to the issuing Terminal (or a Refund Till if the issuing Terminal is a Till-point Terminal) within 120 minutes of the time when it was purchased or before the close of sales for the relevant Draw or the close of Ticket sales for that Retailer on that day, whichever is the earlier; and
        • (b) the Ticket can be cancelled through the bar code reading device and optical mark reader on the Terminal or, in the case of a Ticket issued by a Till-point Terminal, through the manual entry of the 19 digit serial number displayed on the Ticket and the Player's receipt by the Retailer. In the event that the Ticket to be cancelled is not readable by the bar code reading device and/or the optical mark reader, the Retailer will be required to contact the Company to receive authorisation for cancellation. In the event that the Player cannot provide the 19 digit serial number displayed on the Ticket and the Player's receipt for a Ticket issued by a Till-point Terminal, it will not be possible to cancel such Ticket.
      • (3) Subject to Rule 4(G)(4) and (8) below, a Ticketless Entry may be cancelled if:
        • (a) the Player attends the Refund Till within 120 minutes of the time when the Ticketless Entry was purchased or before the close of sales for the relevant Draw or the close of Ticket sales for that Retailer on that day, whichever is the earlier; and
        • (b) the Player provides the Retailer with sufficient information to enable the Ticketless Entry to be cancelled. In the event that the Player cannot provide the 19 digit serial number displayed on the Ticket and the Player's receipt for the transaction, it will not be possible to cancel the Ticketless Entry.
      • (4) Subject to Rule 4(G)(8) below, and in relation to certain Till-point Terminals, all Tickets and/or Ticketless Entries for Draw-Based Games issued by a Till-point Terminal in a single Transaction will be cancelled automatically by the Refund Till if a Player cancels any one of the Tickets and/or Ticketless Entries issued in that Transaction.
      • (5) For Tickets purchased at a Terminal, other than a Till-point Terminal, prior to returning a Ticket to the issuing Terminal for cancellation a Player should fill in with pen the 'VOID' box on the Ticket.
      • (6) On cancellation of a Ticket or a Ticketless Entry the Player will be entitled to a refund from the Retailer equal to the retail price of the Ticket or Ticketless Entry.
      • (7) For the avoidance of doubt, a Player may not seek cancellation of a Lucky Dip Ticket by reason only of the Lucky Dip Entry(ies) on the Ticket not being to his liking.
      • (8) A Ticket or a Ticketless Entry may only be cancelled if the corresponding Entry is actually deleted from the Central Computer System within the period specified in Rule 4(G)(2)(a) above, or as the case may be, Rule 4(G)(3)(a) above.
    • (H) Refunds in Certain Circumstances

      • (1) Notwithstanding Rule 4(W)(5) of these Rules, in the event of a Cancelled Draw the Company shall:
        • (a) refund to a Player who has purchased either a Ticket for the Cancelled Draw only or a Multi-draw Ticket for the Cancelled Draw and other Draws, an amount equal to that part of the Ticket purchase price as was paid in respect of and is attributable to the Cancelled Draw;
        • (b) refund to Offline Direct Debit Players who hold a valid Offline Direct Debit for Draws which include the Cancelled Draw that proportion of the amount previously paid by the Offline Direct Debit Player for that Offline Direct Debit as was paid in respect of and is attributable to the Cancelled Draw;
        • (c) pay to a Player who holds a Voucher Ticket for the Cancelled Draw the amount which would have been properly payable by the Player had the Player purchased that Ticket from a Retailer;
        • (d) refund to a Player who has purchased a Ticketless Entry for the Cancelled Draw an amount equal to the purchase price as was paid in respect of and is attributable to the Cancelled Draw.
      • (2) Any refund and payment under Rule 4(H)(1)(a), 4(H)(1)(c) and 4(H)(1)(d) above respectively must be claimed by the Player. The methods of claiming, payment, the validation of claims and (subject to Rule 4(H)(3) below) the period within which such claims may be made shall be as determined by the Company in its absolute discretion from time to time but subject to the prior agreement of the Commission. A Player will in any event be required to produce the Ticket before any refund or payment will be made except in the case of a Ticketless Entry, when a Player must provide such information as the Company may require to satisfy itself that such Player is the owner of such Ticketless Entry.
      • (3) The period referred to in Rule 4(H)(2) above shall be a period expiring not earlier than the day 90 days after the date on which the Cancelled Draw was to have taken place.
      • (4) Any refund under Rule 4(H)(1)(b) above shall be made by such means and within such period as the Company shall in its absolute discretion determine from time to time but subject to the prior agreement of the Commission.
      • (5) Neither the Company nor any Retailer shall in any circumstances be liable to pay interest in respect of refunds or payments made under this Rule 4(H).
      • (6) For the avoidance of doubt, this paragraph shall not apply in respect of any Draw which is delayed or postponed nor in respect of any Draw which is cancelled but which is not a Cancelled Draw as defined in these Rules.
    • (I) Purchase and Prize Restrictions

      • (1) There shall be no general right for any person to purchase a Ticket or an Offline Direct Debit. In particular, but without limitation, no Ticket or Offline Direct Debit may be purchased by or Prize paid to:

        • (b) directors and employees of the Company;
        • (c) specified employees of such key contractors and sub-contractors to the Company as may be specified from time to time by the Commission;
        • (d) personal partners and persons who are, to some extent, maintained by one of any of the persons referred to in Rules 4 (I)(1)(b) and (c) above, if living in the same household as any such person; and
        • (e) such other persons or category of persons as the Company and the Commission may agree from time to time;
        • (f) any person who is prevented from playing the National Lottery by virtue of the Commission's Codes of Conduct.
      • (2) If notwithstanding Rule 4(I)(1) above a Prize is paid to a person not permitted by that Rule to be paid a Prize, such Prize shall be repayable by that person to the Company upon demand.
      • (3) The Company or any Retailer, in its sole discretion, may limit the number of Entries into a Game proposed to be made by or refuse to issue Play Cards and/or sell Tickets and/or Offline Direct Debit to any person or persons without giving reasons, but which may include circumstances in which, in its view, that person or persons is or are playing in a manner which it or the Retailer deems to be interfering with other Players' or potential Players' reasonable access to the relevant Game.
      • (4) Entries may only be made (a) manually using the Terminal keypad or (b) by means of a Play Slip hand-marked by or on behalf of the Player, or a Play Card or (c) by completion of the Company's standard Offline Direct Debit form or (d) by application for an Offline Direct Debit by telephone or (e) by such other means specifically approved by the Company.
      • (5) Players must not use or seek to use facsimiles or copies of Play Slips or Play Cards or of other materials (if any) which are inserted into the Terminal's Play Slip reader or read by the Terminal's barcode reader which are not printed or approved by the Company.
    • (J) Game Procedures

      • (1) The Game Procedures (excluding any Game Specific Rules) for each Draw-Based Game and/or the Players' Guide shall contain at least the following information:

      • (2) Each Draw-Based Game Draw will select winning numbers at random with the aid of mechanical drawing equipment or such other equipment as the Company may from time to time determine.
      • (3) All Draw-Based Game Draws will be conducted in accordance with the Draw Procedures and in the presence of a witness who will be a representative of an independent accounting firm.
      • (4) The Winning Numbers of the Draw shall be those drawn and as recorded in writing by a witness as described in Rule 4(K)(3) above.
      • (5) In the event of any Draw-Based Game draw being declared invalid, in accordance with the Draw Procedures applicable to it, another draw will be conducted to determine the Winning Numbers in accordance with such Draw Procedures.
      • (6) In the event that any Game Draw is interrupted due to equipment failure or for any other reason the Draw will be completed in accordance with the applicable Draw Procedures for that Game.
      • (7) In the event that the Game Draw cannot take place on the date or at the time fixed, it shall take place as soon as reasonably practicable thereafter.
      • (8) Draw-Based Game Draws will, as far as practicable, be recorded on a video and audio tape which will be retained by the Company but failure by the Company to record the Draw or retain the tape or the partial or total failure of technical, electronic, or mechanical equipment used to record or broadcast the Draw will not invalidate the Draw.
      • (9) The Company shall have no obligation to make any payment against any incorrectly announced number at the Draw. In such an event, the witness as described in Rule 4(K)(3) above shall confirm the correct number.
    • (L) Dissemination of Winning Numbers Information

      • (1) The results of each Draw will be made available at Retailers' outlets and on the Site as soon as practicable after each Draw. Results will be issued by the Company to the national media and may also be published in such other manner as the Company may from time to time determine.

        • (e) such other information as the Company may from time to time determine.
      • (3) The dissemination and publication of Winning Numbers by telephone and in the media and at the Retailers' outlets is for information purposes only, and the Company will not pay a Prize based upon information obtained from winning number information telephone lines or any source other than the official results of the relevant Draw recorded as in Rule 4(K)(4) above and electronically recorded in the Central Computer System.
    • (M) Release of Information About Winners

      Save for the purposes of publicising unclaimed Prizes or as is required by law, and subject to Rule 4(E)(19)(a) above, the Company may not publicise any details of any Prize winner without the prior written consent of that person.

      Players accept and understand that: a) if a winning Ticket is presented for validation or to claim a Prize at a Terminal (except a Till-point Terminal), an audible alert on the Terminal may sound to indicate to the Player and the Retailer that the Ticket is a winner and/or a prize entitlement message may be presented; and b) the audible alert may be heard (and the prize entitlement message may be seen) by other persons nearby.

    • (N) Use of Prize Claim Forms

      • (1) A Prize Claim Form must be completed in the case of a claim by an Offline Direct Debit Player for a Prize in excess of £50,000 and in the case of a claim by any other Player for a High-Tier Prize. The Company reserves the right, at its discretion, to require the completion of a Prize Claim Form in any case.
      • (2) A Prize Claim Form must be completed in the name of one owner and (save in relation to an Offline Direct Debit or a lost, stolen or destroyed Ticket or a Ticketless Entry in respect of which a claim is made under Rule 4(P)(1) below), be accompanied by a Valid Winning Ticket. However, the Company may exceptionally, and at its sole discretion, waive the requirement in respect of a Prize Claim Form for a particular Prize claim (but not, in the case of the holder of a Ticket, the requirement to provide a Valid Winning Ticket), such waiver to be in writing and subject to such terms and conditions as the Company shall require.
      • (3) All Prize Claim Forms shall be completed and signed by the owner of the relevant Ticket or Offline Direct Debit or, as the case may be, the person who purchased the Ticketless Entry, or by his duly authorised representative.
      • (4) The Company may refuse to process any payment if the relevant Prize Claim Form is incomplete.
      • (5) If a Claimant is unable to complete a Prize Claim Form due to legal, physical, or other disability, a duly authorised representative of the Claimant may complete and sign a Prize Claim Form on his behalf. The Prize Claim Form must state the name of the Claimant and the representative and describe the status of the signatory, if not the Claimant. The Company reserves the right to request evidence of the capacity of a representative to claim on behalf of a Claimant.
      • (6) If the person signing the Prize Claim Form is a personal representative of the estate of a deceased winner, that person shall submit with the Prize Claim Form letters of administration or grant of probate showing that appointment or such other documentation as the Company shall in its discretion deem sufficient properly to establish such representative's entitlement to receive the relevant Prize or Prizes.
      • (7) Payment of the Prize to the person shown on the Prize Claim Form as the Claimant or his duly authorised representative shall fully and effectively discharge the Company, its officers, employees, representatives, contractors and any person, firm or company authorised by the Company to pay Draw-Based Game Prizes from any further liability for payment of that Prize.
      • (8) A person who signs a Prize Claim Form shall be deemed to have represented that he is lawfully entitled to the Prize and the information contained therein is accurate and complete, and shall indemnify the Company against any costs, losses, damages and expenses which the Company may suffer or incur with respect to the Entry or delivery of the Prize as a result of any misrepresentation.
      • (9) In the event of any inconsistency in the information submitted on the Prize Claim Form and/or shown on the Ticket or for any other reason at its complete discretion, the Company may investigate and withhold all winnings which may be due to the Claimant (or may make a payment into court) until such time as the Claimant satisfies the Company that he is the proper person to whom the Prize should be paid.
    • (O) Ticket Validation Requirements

      • (1) Before a Prize may be paid on any Ticket, it must be validated according to the Company's validation procedures set out or referred to in these Rules as such validation requirements may be amended by the Company from time to time. The Company's decision as to whether or not the Ticket is valid shall be final and binding. Without prejudice to the generality of the foregoing:
        • (a) the Company shall declare a Ticket invalid, and accordingly shall not pay any Prize, if:
          • (i) the Ticket has been cancelled, whether in accordance with the Company's normal procedure for cancellation or otherwise;
          • (ii) subject to Rule 4(P), the Company reasonably believes that the Ticket has been stolen;
          • (iii) the ticket is counterfeit, has been forged in whole or in part or fails to pass the Company's confidential validation and security tests appropriate to the method of play;
          • (iv) the Control Number of an apparent winning Ticket does not appear on the Company's official list of Control Numbers of winning Tickets or a Valid Winning Ticket with that Control Number has been paid previously;
          • (v) the Ticket does not appear on the Company's list of Tickets issued for Entry to the particular draw kept on the Central Computer System;
          • (vi) the Company reasonably believes that the Ticket was purchased by any person in any of the classes of individuals listed in Rule 4(I)(1).
        • (b) The Company may at its discretion declare a Ticket invalid and accordingly shall not be obliged to pay any Prize if:
          • (i) the Ticket is mutilated, altered, unreadable, incomplete or tampered with in any manner;
          • (ii) any number on the Ticket is not present in its entirety or is not fully legible;
          • (iii) the data on the Ticket fails in any material respect to match the record of that Ticket on the Central Computer System; or
          • (iv) the Ticket has not been issued or sold in an authorised manner by the Company or by a Retailer.
      • (2) Subject to the provisions of Rule 4(P) below, and except in the case of Offline Direct Debit, a Ticket shall be the only valid proof that an Entry was made and a Valid Winning Ticket shall be the only valid instrument for claiming a Prize.
      • (3) A Claimant shall be entitled to claim only the highest tier of Prize for which the validated Ticket is eligible and not any lesser Prize category or any otherwise unclaimed Prize in the particular Draw or Prize pool.
      • (4) The Company reserves the right to withhold payment of any Prize until it is entirely satisfied as to the validity of any Ticket or Offline Direct Debit and the good faith of the Claimant, and reserves the right to call for proof of identity and capacity to claim.
      • (5) The Company reserves the right to photograph any Claimant for security purposes.
      • (6) The Company reserves the right to retain any Ticket submitted to the Company for validation.
    • (P) Stolen, Lost, Found, Destroyed Tickets and Ticketless Entries

      Prize Claim Notice
      • (1) If there is a Ticket which has been stolen, lost or destroyed, or if there is a Ticketless Entry which has not been cancelled, and the Claimant:
        • (a) in respect of such stolen, lost or destroyed Ticket, believes he may otherwise have had a Valid Winning Ticket in a particular Draw; or
        • (b) in respect of such Ticketless Entry:
          • (i) does not know the number selection(s) comprised in such Ticketless Entry and wishes to know such selection(s) and whether or not he may otherwise have had a Valid Winning Ticket in a particular Draw; or
          • (ii) knows the number selection(s) comprised in such Ticketless Entry and believes he may have otherwise have had a Valid Winning Ticket in a particular Draw,
          and the Claimant, in respect of the theft, loss or destruction of that Ticket, gives a Prize Claim Notice or the Claimant, in respect of such Ticketless Entry, gives a Prize Claim Notice, to the Company in accordance with Rule 4(P)(2) below and such notice is received by the Company's Prize Payout Department at The National Lottery, PO Box 287, Watford WD18 9TT or such other address advised by the Company from time to time by 17:00 hours on the 30th day after the date of the relevant Draw, then (provided, in its discretion, it considers the information given in the Prize Claim Notice is sufficient to enable it to do so) the Company:
      • (c) in the circumstances described in Rule 4(P)(1)(b), if it is satisfied as to the existence of the Ticketless Entry and that it was purchased by the Claimant, will inform the Claimant of the number selection(s) comprised in such Ticketless Entry and will investigate and consider the validity of the claim for a Prize; and
      • (d) in the circumstances described in Rule 4(P)(1)(a) , may, at its discretion, investigate and consider the validity of the claim; and
      • (e) if it is satisfied that the claim for a Prize made pursuant to Rules 4(P)(1)(a) or (b) is valid, may, at its further discretion (but subject to Rule 4(N), (S), (T) and (U)), pay the Prize within a reasonable time following 180 days after the date of the relevant Draw.
    Content of Prize Claim Notice
    • (2) The Prize Claim Notice must:
      • (a) be given in writing by the person who owns or owned the stolen, lost or destroyed Ticket or who purchased the Ticketless Entry; and
      • (b) include, to the best of the Claimant's knowledge, the date, time and place of purchase of the relevant Ticket or Ticketless Entry, the Game(s) and Draw date(s) for which that Ticket or Ticketless Entry was purchased, the date(s) of the Draw(s) for which the Claimant believes that Ticket or, had it been printed, the ticket to which that Ticketless Entry relates would have been a winning Ticket and the number of number selections and the numbers selected.
    • (3) For the avoidance of doubt, the Company will not accept a Prize Claim Notice in respect of a Ticket or Ticketless Entry after 17:00 hours on the 30th day after the date of a Draw for which the Claimant alleges that the Ticket was or, had it been printed, the ticket to which the Ticketless Entry relates would have been, a Valid Winning Ticket and such notice will be invalid in respect of the claim for that Draw.

    Lost Ticket Notice and Found Tickets

    Timescales in which to submit a Lost Ticket Notice
    • (4) A Lost Ticket Notice must be given in writing by the person who owns or owned the lost or stolen Ticket to the Company's Prize Payout Department at The National Lottery, PO Box 287, Watford, WD18 9TT or such other address as advised by the Company from time to time. The Lost Ticket Notice must be given after 17:00 hours on the 30th day after the date of the relevant Draw and must be received by the Company's Prize Payout Department by 17:00 hours on the 180th day after the date of such Draw. Any prize entitlement in relation to a Ticket to which a Lost Ticket Notice relates will be determined by Rule 4(P)(7) below.
    Content of a Lost Ticket Notice
    • (5) A Lost Ticket Notice must include, to the best of the claimant's knowledge, the date, time and place of purchase of the lost Ticket, the Game(s) and Draw date(s) for which that Ticket was purchased, the date(s) of the Draw(s) for which the Claimant believes that Ticket would have been a winning Ticket (if applicable) and the number of number selections and the numbers selected.
    Found Tickets
    • (6)
      • (a) A Finder who finds a Ticket:
        • (i) which does not bear an individual person's name or address or other indication of ownership; or
        • (ii) which does have such a name or address but such information is illegible, inaccurate or incomplete so as to prevent the Finder returning the Ticket to the rightful owner
        should, if the Ticket is valid for a future Draw or Draws or is a winning Ticket for a Draw which has taken place but in respect of which the Claim Period has not expired, submit the Ticket to the Company at the Company's Prize Payout Department at The National Lottery, PO Box 287, Watford, WD18 9TT or such other address advised by the Company from time to time with a covering letter or note containing the name, address and contact telephone number of the Finder and information as to the circumstances of his finding of the Ticket and steps (if any) taken by him to return the Ticket to its rightful owner.
    • (b) If on or after its receipt by the Company under Rule 4(P)(6)(a) above that Ticket is or becomes a Valid Winning Ticket and
      • (i) no valid Prize Claim Notice or Lost Ticket Notice is or has been received by the Company in respect of it; and
      • (ii) after such investigation and such enquiries of the public as it considers appropriate, the Company is in its discretion satisfied that the Finder took all reasonable steps to return the Ticket to its rightful owner before submitting it to the Company and is satisfied that the Ticket was lost by or stolen from the rightful owner and found by the Finder,
      then within a reasonable time following 180 days after the date of the relevant Draw but without prejudice to Rule 4(S)(8) and Rule 4(U)(2), the Company may at its discretion pay the Prize to the Finder.
    Found Tickets - Entitlement to Prizes
    • (7) If a Ticket is submitted by a Finder under Rule (P)(6) above the details of which, in the Company's reasonable opinion, match those given by the Claimant in the Prize Claim Notice or the Lost Ticket Notice, then the Company may (provided in its discretion, it considers the information given in the Prize Claim Notice or the Lost Ticket Notice is sufficient to enable it to do so), at its discretion investigate and consider the validity of the Claimant's claim and, if satisfied that the claim is valid, at its further discretion pay the Claimant the Prize within a reasonable time following 180 days after the date of the relevant Draw.
    Prize Claim Notice or Lost Ticket Notice for Multiple Draws
    • (8) For the avoidance of doubt, if there is more than one Draw for which the Claimant believes the Ticket or, had it been printed, the ticket to which the Ticketless Entry relates would have been a Valid Winning Ticket, then a Prize Claim Notice or Lost Ticket Notice (as applicable) must be received by the Company by 17:00 hours on the 30th day or 180th day respectively after the date of the Draw in respect of which the claim is being made. No further Prize Claim Notice or Lost Ticket Notice shall be required in respect of any subsequent Draw(s) for which that Ticket or, had it been printed, the ticket to which the Ticketless Entry relates would have been valid.
  • (Q) Disputes

    If a dispute arises between the Company and the owner of a Ticket or a Ticketless Entry Claimant as to whether a Ticket or Ticketless Entry is or would have been a Valid Winning Ticket and the Prize claimed has not been paid, the Company may, solely at its option, reimburse the cost of the Ticket or Ticketless Entry or replace the disputed Ticket or Ticketless Entry with a Ticket of equivalent sales price for any current Draw-Based Game. This shall be the owner of the Ticket's or Ticketless Entry's or Claimant's sole and exclusive remedy, and such reimbursement or replacement shall fully discharge the Company from any liability in respect of such dispute.

  • (R) Game Termination and Prize Claim Period

    • (1) The Company may at any time announce the termination date for an individual Game. If this occurs no Tickets for such Game will be sold after the termination date.
    • (2) Subject to Rule 4(R)(3) below, Draw-Based Game Prizes must be claimed within the ordinary hours of business of the Company or (as appropriate) the relevant establishment authorised to pay Prizes but in any event before the end of the Claim Period. Any such Prize not so claimed within the Claim Period will be forfeited. If a Prize is claimed in person any relevant completed Prize Claim Form and the Valid Winning Ticket must be received by a Retailer or by the Company at the Claimant's home, other agreed location or at any Regional Centre (as appropriate) within the Claim Period. If a Prize is claimed by post the Ticket and any relevant completed Prize Claim Form must be received by the Company at the address of The National Lottery shown on the reverse of the Ticket within the Claim Period. Postal claims are made at the Claimant's own risk and the Company accepts no liability for Tickets and/or Prize Claim Forms lost or delayed in the post.
    • (3) A Prize may be claimed at a Regional Centre by the Claimant presenting the Valid Winning Ticket, proof of identity and any relevant completed Prize Claim Form at that Regional Centre within seven days after the end of the Claim Period PROVIDED THAT before the end of the Claim Period the Claimant shall have contacted the Company and notified it of his intention so to claim and of his name, address and all such details of the Ticket as the Company shall reasonably require at that time. For the avoidance of doubt, where a Claimant contacts the Company by telephoning the National Lottery Line, this must be during its normal operating hours from time to time (which are currently 9:00 - 23:00 hours Wednesdays, Fridays and Saturdays, 9:00 to 15:00 hours Sundays and 9:00 to 17:30 hours on other days, excluding Christmas Day). Where the Claimant contacts the Company by emailing help@national-lottery.co.uk, the email must be received by the Company before 23:00 hours on the last day of the Claim Period. If the Claimant fails to claim within the said seven days, the Prize will be forfeited and will be transferred to the National Lottery Distribution Fund.
  • (S) Payment to Prize winners in Person

    • (1) Subject to the provisions of these Rules and save in the case of Offline Direct Debit, in particular Rules 4(E)(19) and (20), Retailers are authorised and required to make payment in cash of Prizes of £100 or less (£50 or less at selected Retailers with Till-point Terminals), and may make at their discretion payment in cash of Prizes from £100 to £500 (or such higher amount as authorised by the Company). Certain Retailers with Till-point Terminals may, at their discretion, pay such Prizes onto a Prize winner's debit or credit card instead of in cash. In the event that a Prize winner submits a Ticket to a Retailer which is then scanned into the Central Computer System and the Prize is in excess of the payment authority of that Retailer, the Player shall be advised by the Retailer of the appropriate method to claim the Prize.
    • (2) Subject to Rules 4(E)(19) and (20), certain designated Post Offices in the United Kingdom and one or more designated Retailers in the Isle of Man will be allowed to pay any Prize up to £50,000 by cheque(s) or by a combination of cheque(s) and up to £500 in cash.
    • (3) The owner of a Valid Winning Ticket representing a Prize in excess of £500 and up to and including £50,000 shall submit such Valid Winning Ticket together with a completed Prize Claim Form and proof of identity, to a designated Post Office in the United Kingdom, a designated Retailer in the Isle of Man or a Regional Centre.
    • (4) Claims for Prizes of over £50,000 must be made in person and shall be paid only at the Claimant's home, other agreed location or at a Regional Centre.
    • (5) The Company will make payment by cheque or direct credit in accordance with Rule 4(E)(19) in respect of Offline Direct Debit, and in all other cases reserves the right to make payment by cheque, other approved instrument or direct credit.
    • (6) In the event that a single Ticket contains multiple winning Entries each from separate Selections the Prize amounts may be added together and shall be paid in accordance with the Prize payment arrangement specified above. If in respect of one Draw, an Offline Direct Debit contains multiple winning Entries each from separate Selections the Company shall have a discretion as to whether or not to add the prize amounts together for the purpose of determining the payment method applicable to such amounts.
    • (7) Neither the Company nor any Retailer shall be responsible or liable to any person claiming an interest of whatever nature in a lost or stolen Ticket as a result of the payment of a Prize to the holder of an unsigned Ticket or to the person purporting to be the person whose name is entered on the Ticket whether or not advice of the loss or theft had been notified to the Company prior to payment of the Prize. Without prejudice to the above, the Company shall use its best endeavours to carry out and ensure that any Retailers or other persons responsible for payments of Prizes shall carry out such identity checks and other security measures as the Company shall in its discretion from time to time deem reasonable and appropriate in relation to payment of any particular Prize amount.
    • (8) Without prejudice to Rule 4(P) above, in the event that the Company, in its absolute discretion, believes that the holder of a Ticket presented for payment or a person whose name has been entered on the Ticket or who has completed a Prize Claim Form is not the rightful owner thereof or lawfully entitled thereto, it shall be entitled to withhold payment of any Prize winnings pending the outcome of all appropriate checks and enquiries.
    • (9) The Company shall not be liable to make payment of any Prize on a Ticket which it knows or suspects has been resold or otherwise transferred by way of trade.
    • (10) The Company shall not be liable to pay interest on any winnings in respect of any period during which security or other relevant checks or enquiries are in process regarding any Ticket or Offline Direct Debit presented for payment by a Claimant or during any period in which a dispute relating to the validity of a Ticket or Offline Direct Debit or a claim has not been resolved.
  • (T) Prize Payment by Mail for Valid Winning Tickets

    • (1) With respect to a Valid Winning Ticket with a Prize of £50,000 or less, the Prize may be claimed, entirely at the Claimant's risk, by posting the Valid Winning Ticket together with a completed Prize Claim Form if a High-Tier Prize to The National Lottery at the address shown on the Prize Claim Form. The Ticket shall contain the name and address of the Claimant on the reverse side. If a Ticket is sent to The National Lottery that does not have a name appearing on the reverse side of the Ticket, payment will be made subject to the provisions of these Rules to the person whose name appears on the Prize Claim Form or, if no Prize Claim Form is required to be submitted, to the Claimant.
    • (2) The Company will pay such Claimant at the Claimant's risk by cheque in accordance with the Company's procedures provided that all the Ticket Validation Requirements have been met.
  • (U) Payments to Persons Under a Legal Disability

    • (1) The Company will make payment to the duly authorised representative of a person under legal or other disability.
    • (2) The Company may apply to a court of competent jurisdiction to determine the lawful payee in any particular case.
    • (3) Save as provided above, the right of any person to a Prize shall not be assignable.
  • (V) General

    • (1) Any person who obtains a Play Card, purchases a Ticket or an Offline Direct Debit or submits a Ticket for validation or submits a Prize Claim Form, Prize Claim Notice or Lost Ticket Notice or who otherwise claims a Prize in whatever capacity, agrees to be bound by the provisions of the Act, any Regulation made thereunder, the provisions of these Rules, and the Game Procedures and any other procedures issued from time to time by the Company in respect of the relevant Game, as such Rules, Game Procedures and other procedures may be amended by the Company from time to time.
    • (2) Each Prize winner is deemed to acknowledge that, if and to the extent that the Company is legally obliged to provide a third party with details of any Prize claimed by or on behalf of or paid to the Prize winner, the Company shall be entitled to do so. The Company shall also be entitled to pass personal information about the Players to the Gambling Commission or another third party acting on behalf of the Company to verify and/or use such information for the purposes specified in these Rules.
    • (3) The Company may amend, modify, or otherwise change these Rules and any Game Procedures, Draw Procedures and any other procedures issued by the Company from time to time. Such amendments, modifications or changes shall be applicable with effect from their introduction and, so far as they relate to claim procedures, shall be applicable to prior Draws.
    • (4) Where the context so requires, in these Rules, the neuter gender shall include the feminine or masculine gender and vice versa, the feminine gender shall include the masculine gender and vice versa and the singular shall include the plural and vice versa.
    • (5) In the event that any provision of these Rules, of the conditions and explanations appearing on a Play Slip, Play Card or a Ticket or an Offline Direct Debit Confirmation or of such other conditions as are established by the Company are determined by a court of competent jurisdiction to be void or unenforceable, such determination shall solely affect such provision and shall not, in itself, render void or unenforceable the remaining provisions hereof.
    • (6) Where Claimants provide the Company with personal information about themselves in relation to a Prize claim (such as their name, address, and bank details), the Company may hold and process that personal information in respect of that Prize claim and to fulfil its obligations under the licence granted to it by the Commission pursuant to Section 5 of the Act. By passing personal information to the Company, Claimants agree and consent to such processing of their personal information by the Company.
    • (7) The Company may also record telephone calls made between Company representatives and any person for both parties' protection.
    • (8) References to statutory provisions shall be construed as reference to those provisions as respectively replaced, amended or re-enacted from time to time and shall include any provision of which they are re-enactments (whether with or without modification) and any subordinate legislation made under such provisions.
    • (9) The Commission is an intended beneficiary of these Rules and may enforce any of these Rules under the terms of the Contracts (Rights of Third Parties) Act 1999.
    • (10) The Company has agreed a procedure with the Commission for dealing with non player funded Entries that cannot be withdrawn from a Draw(s). In such circumstances the Company or a relevant third party will pay for the non player funded Entries and any prize attributed to a non player funded Entry will be transferred to The National Lottery Distribution Fund or the Olympic Lottery Distribution Fund at the end of the Claim Period. No adjustment will be made to Prizes attributed to other Winning Entries as defined in the relevant Game Procedures. For this Rule only, in the event of any ambiguity or inconsistency between the Rules and the relevant Game Procedures, this Rule shall prevail.
  • (W) Limitation of Liability

    • (1) The Retailer is authorised by the Company to issue Tickets (and certain Retailers are authorised by the Company to issue Play Cards), to pay Prizes in respect of Valid Winning Tickets and to process Ticket cancellations in relation to Draw-Based Games in accordance with these Rules and to display and/or have available information produced by the Company in respect of such Games. Save as specified in the written agreement between the Company and the Retailer, a Retailer is not authorised by the Company to carry out any other acts or make any admissions whatsoever.
    • (2) Subject to Rule 4(O)(1)(b), if a Ticket is purchased which at the time of issue is illegible or incomplete or contains the words "void" or "not for sale" or similar wording it shall be void and the Company's only liability shall be reimbursement of its cost.
    • (3) Subject to Rule 4(W)(4) below, if a Ticket or Ticketless Entry which is purchased is cancelled whether in accordance with the Company's normal procedures for cancellation or otherwise, the only liability of the Company (or the Retailer, as the case may be) shall be the reimbursement of the cost of that Ticket or Ticketless Entry.
    • (4) If the Company shall determine to its entire satisfaction after due and careful enquiry by it that cancellation of a Ticket or Ticketless Entry was not authorised by the Player and such cancellation was wholly and directly the result of fraud, negligence or error by the Company or a Retailer then, if such Ticket or, had it been printed, the ticket to which such Ticketless Entry relates would, but for that cancellation, have been a Valid Winning Ticket, in relation to which the Player may have submitted a Prize Claim Notice in accordance with Rule 4(P), the Company shall not reimburse the cost of the Ticket and the Company's only liability shall be to pay an amount equal to that Prize to the person who would have been entitled to that Prize under these Rules but for such cancellation.

      • (b) for the failure of, or damage or destruction to, or any errors caused by the Central Computer System or the Company's records, or any part thereof;
      • (c) for delays, losses, errors or omissions in or made by the postal or other delivery service or by the banking system;
      • (d) for any other action or event which prevents or hinders the registration of a valid Entry or the issue of a valid Play Card or Ticket;
      • (e) for the refusal to issue a Play Card or sell an Entry to any person in accordance with these Rules or to allow any person to play a Game;
      • (f) for any losses caused by Players including money lost by playing the Games and failure or malfunction of the equipment or technology of the relevant Player or his internet service provider.
    • (6) The Company shall have the right to suspend or withdraw any Game and/or to suspend the play of any Game from any Terminal and/or to deactivate any Terminal at its absolute discretion at any time.
    • (7) Nothing in these Rules shall exclude or limit any person's liability for (a) fraud; (b) death or personal injury caused by its negligence (as defined in section 2 of the Unfair Contract Terms Act 1977); (c) any breach of the terms implied by section 12 Sale of Goods Act 1979 or Section 2 of the Supply of Goods and Services Act 1982; or (d) any other liability which is not lawfully permitted to exclude or limit.
    • (8) Players acknowledge and agree that they do not rely on, and shall have no remedy in respect of, any statement, representation or warranty (in each case whether negligently or innocently made) or understanding of any person (whether or not such person is a party to these Rules).

In the event of a dispute in respect of a Valid Winning Ticket, an Offline Direct Debit, a Ticketless Entry, a Prize Claim Form, or the payment or awarding of any Prize, the Company may withhold payment of the Prize and/or make an equivalent payment into court until any dispute has been resolved.

      • (20) Direct Debit Prizes of over £50,000 must be claimed in person at the Online Direct Debit Player's home, other agreed location or at a Regional Centre and will be payable by cheque, other approved instrument, or direct credit at the Company's option. The Company will contact the Online Direct Debit Player and invite him to claim the Direct Debit Prize at the Online Direct Debit Player's home, other agreed location or at a Regional Centre.
      • (21) Claimants may be required to present such identification as proof of entitlement to Direct Debit Prizes as the Company shall require (including, without limit, Identification Information and capacity to claim). The Company reserves the right to withhold payment of any Direct Debit Prize until it is entirely satisfied as to the validity of any Direct Debit Play and the good faith of the Claimant. The Company reserves the right to photograph any Claimant for security purposes.
      • (22) The Company reserves the right to cancel, alter or modify at any time the whole or any part of the Draw-Based Game for which the Online Direct Debit Player has a Direct Debit Play, including these Rules and the Game Procedures relating to that Draw-Based Game, and to cancel, alter or modify the Direct Debit Play or any condition attaching to Direct Debit Play to the extent necessary or appropriate to reflect any such cancellation, alteration or modification and to notify the Online Direct Debit Player as the case may be, of such cancellation, alteration or modification of that Direct Debit Play.
      • (23) Subject to Rule 4(B)(22), in the event of cancellation of a Draw, the Company will provide the Online Direct Debit Player with an equivalent Direct Debit Play on an alternative Draw Date. In the event of the cancellation of a Direct Debit Play the Company will make a proportionate refund to the Online Direct Debit Player.
      • (24) In the event of alteration or modification of a Draw-Based Game or a Draw, or of any conditions attaching to playing by Direct Debit, or of any cancellation of playing by Direct Debit or of any other alteration or modification to playing by Direct Debit the Company may cancel the existing Direct Debit Play(s), issue new Direct Debit Play(s), Direct Debit Play Slip, Direct Debit Details and Ticket(s) reflecting such cancellation, alteration or modification. The new Direct Debit Play(s) shall commence from the first Draw date recorded in the Direct Debit Details.
      • (25) The Company, at its absolute discretion and without specifying any reason, may cancel playing by Direct Debit or partially cancel playing by Direct Debit by removing one or more Games from being available to play by Direct Debit, with effect from the next Draw of the Game, and:
        • (a) in the event of a cancellation of a Direct Debit Play the Company's only liability to the Online Direct Debit Player shall be to repay to the Online Direct Debit Player any monies previously paid in respect of Direct Debit Play for any Draw of the Draw-Based Game to which the Direct Debit Play relates occurring after such cancellation and to pay to the Online Direct Debit Player any unpaid Prizes due to him in respect of Draws prior to such cancellation; or
        • (b) in the event that playing by Direct Debit is partially cancelled, the Company's only liability to the Online Direct Debit Player shall be to repay to the Online Direct Debit Player any monies previously paid which are attributable to the Draw of the Draw-Based Game which has been removed from the Direct Debit Play but only in respect of the Draws occurring after such partial cancellation and to pay to the Online Direct Debit Player any unpaid Prizes due to him in respect of Draws of the Draw-Based Game prior to such cancellation.
      • (26) On termination or cancellation of playing by Direct Debit, the Company will return the Online Direct Debit Player's paid unutilised monies to the bank (or building society) account, details of which are held by the Company in respect of that Online Direct Debit Player, or return the balance to the relevant Online Direct Debit Player by other appropriate means. In the event that the Company is not able to return the balance to the relevant bank (or building society) account or to the Online Direct Debit Player by other appropriate means, it will retain the balance for a period of six (6) years from the date the Direct Debit Play was terminated after which time such balance will be allocated to the National Lottery Distribution Fund. An Online Direct Debit Player may contact the Company to claim the monies at any time during the six (6) year period during which the Company retains such balance. Subject to the Online Direct Debit Player providing such information as the Company shall reasonably require, the Company shall refund such monies.
      • (27) If a dispute arises between the Company and the Claimant as to whether Direct Debit Play is valid and the Prize claimed has not been paid, the Company may, solely at its option, reimburse the cost of the Direct Debit Play or replace the disputed Direct Debit Play with a Direct Debit Play of equivalent sales price for any current Draw-Based Game. This shall be the Claimant's sole and exclusive remedy, and such reimbursement or replacement shall fully discharge the Company from any liability in respect of such dispute.
    • (C) Play Purchase and Prize Restrictions

      • (1) There shall be no general right for any person to purchase a Play. In particular, but without limitation and subject to Rule 4(C)(5), no Play may be purchased by or Prize paid to:
        • (a) any Minor whether acting on his own behalf or on behalf of another person;

        • (f) any person who is not located in the UK or Isle of Man when seeking to purchase, or at the time of purchasing, the relevant Play;
        • (g) any person who does not meet the criteria set out in Clause 4(A)(1) of the Terms and Conditions and for Online Direct Debit Players, also Rule 4(B)(4);
        • (h) such other persons or category of persons as the Company and the Commission may agree from time to time;
        • (i) any person who is prevented from playing the National Lottery by virtue of the Commission's Codes of Conduct.
      • (2) If, notwithstanding Rule 4(C)(1) above, a Prize is paid to a person not permitted by that Rule to be paid a Prize, such Prize shall be repayable by that person to the Company upon demand.
      • (3) The Company may, in its sole discretion, limit the Plays playable by, or refuse to sell Plays to, any person or persons without giving reasons, but which may include circumstances in which, in its view, that person or persons is or are playing in a manner which it deems to be interfering with other Players' or potential Players' reasonable access to the relevant games.
      • (4) Not used.
      • (5) An employee of the Company shall, with the written consent of the Commission, be able to purchase Plays for the purpose only of testing the processes through which Accounts are operated. Such consent may be granted subject to such terms and conditions as the Commission shall determine including, but without limitation, a prohibition on any employee of the Company or the Company benefiting from any Prize that such purchase wins.
    • (D) Other Agreements

      No Player shall enter into any agreement for the issue of a Play or Plays (or for the giving of a Prize) otherwise than in accordance with these Rules, the Terms and Conditions and any applicable Game Procedures.

    • (E) Game Procedures

      • (f) method of determining Prize winners; and
      • (g) dates and/or frequency of Draws.
    • (F) Drawings

      • (1) The Company will determine the time, frequency, date and method of the Draws for each Draw-Based Game in the relevant Game Procedures (excluding the Game Specific Rules).
      • (2) Each Draw will select winning numbers at random with the aid of mechanical drawing equipment or such other equipment as the Company may from time to time determine.
      • (3) All Draw-Based Game Draws will be conducted in accordance with the Draw Procedures and in the presence of a witness who will be a representative of an independent accounting firm.
      • (4) The Winning Numbers of the Draw shall be those drawn and as recorded in writing by the witness as described in Rule 4(F)(3) above.
      • (5) In the event of any draw for any Draw-Based Game being declared invalid, in accordance with the Draw Procedures applicable to it, another Draw will be conducted to determine the Winning Numbers in accordance with such Draw Procedures.
      • (6) In the event that any Draw is interrupted due to equipment failure or for any other reason the Draw will be completed in accordance with the applicable Draw Procedures for that Draw-Based Game.
      • (7) In the event that any Draw cannot take place on the date or at the time fixed, it shall take place as soon as reasonably practicable thereafter.
      • (8) Draws will, as far as practicable, be recorded on a video and audio tape which will be retained by the Company but failure by the Company to record the Draw or retain the tape or the partial or total failure of technical, electronic, or mechanical equipment used to record or broadcast the Draw will not invalidate the Draw.
      • (9) The Company shall have no obligation to make any payment against any incorrectly announced number at the Draw. In such an event, the witness as described in Rule 4(F)(3) above shall confirm the correct number.
    • (G) Dissemination of Winning Numbers Information

      • (1) The results of each Draw will be made available at Retailers' outlets and on the Site as soon as practicable after each Draw. Results will be issued by the Company to the national media and may also be published in such other manner as the Company may from time to time determine.

        • (b) the date of the Draw;
        • (c) the Winning Numbers;
        • (d) the amount payable for each correct Play in each Prize category;
        • (e) such other information as the Company may from time to time determine.
      • (3) The dissemination and publication of Winning Numbers by telephone and in the media and at the Retailers' outlets is for information purposes only, and the Company will not pay a Prize based upon information obtained from winning number information telephone lines or any source other than the official results of the relevant Draw recorded as in Rule 4(F)(4) above and electronically recorded in the Central Computer System.
    • (H) Release of Information About Winners

      Save for the purposes of publicising unclaimed Prizes or as is required by law, the Company may not publicise any details of any Prize winner without the prior written consent of that person.

    • (I) Play Validation Requirements

      • (1) Before a Prize may be paid on any Claimed Play, it must be validated according to the Play Validation Requirements. The Company's decision as to whether or not the Claimed Play is a Valid Winning Play shall be final and binding. Without prejudice to the generality of the foregoing:
        • (a) the Company shall declare a Claimed Play invalid, and accordingly shall not pay any Prize, if:
          • (i) the Claimed Play is the result of an act perpetrated by the Claimant or other person which was intended to increase the chances of that Claimant or person winning a Prize in the Draw-Based Game above those enjoyed by other Players of that game, or to increase that Prize; or
          • (ii) the Claimed Play is counterfeit, has been forged in whole or in part or fails to pass the Company's confidential validation and security tests; or
          • (iii) the claim in respect of the Claimed Play is not received by the Company by the deadline set by the Company or within the timescale applicable to the particular Draw-Based Game; or
          • (iv) the Ticket Number of a Claimed Play does not appear on the Company's official records of Valid Winning Plays or the relevant Prize in relation to the Valid Winning Play with that Ticket Number has been paid previously; or
          • (v) the details associated with the Ticket Number of a Claimed Play do not match the Company's official records of that Ticket Number; or
          • (vi) the Company reasonably believes that a Claimed Play was purchased by or on behalf of a member of any of the classes of individuals listed in Rule 4(C)(1).
        • (b) the Company may at its discretion declare a Claimed Play invalid and accordingly shall not be obliged to pay any Prize if:
          • (i) the Company reasonably believes that the person claiming the Prize is not the holder of the relevant Account or his duly authorised representative or that the information provided by the person claiming the Prize is incomplete or has been altered or tampered with; or
          • (ii) the Claimed Play has not been issued or sold by the Company; or
          • (iii) the Ticket Number or any other unique feature of the Claimed Play does not correspond precisely with those on the Interactive System in respect of the Draw-Based Game Played Interactively to which the Claimed Play relates and/or the Claimed Play is defective, in whole or in part.
        • (2) A Claimant shall be entitled to claim only the Prize(s) for which the Valid Winning Play is eligible and not any other Prize or any otherwise unclaimed Prize in the particular Draw-Based Game.
        • (3) The Company reserves the right to withhold payment of any Prize until it is entirely satisfied as to the validity of any Claimed Play and the good faith of the Claimant, and reserves the right to call for proof of entitlement to a Prize (including, without limit, Identification Information, proof of identity and capacity to claim) and to recover a Prize that has been incorrectly paid (including, without limitation, where such payment has been made into a Player's Account).
        • (4) The Company reserves the right to photograph any Claimant for security purposes.
      • (J) Responsibility for Plays and Tickets

        • (1) Each Player is responsible for verifying that the Selection(s), the Games, the dates and frequency of Draws set out on the Ticket correspond with those marked on his Interactive Play Slip and/or Direct Debit Play Slip and/or Direct Debit Details.
        • (2) Each Player is responsible for the safe custody of any information required to make a claim on a particular Play (including, without limitation, the relevant Ticket Number). Failure by a Player to produce sufficient Identification Information on claiming a Prize will result in refusal by the Company to pay the Prize.
        • (3) Each Player is responsible for claiming and checking that he receives the full value of the Prize to which he is entitled.
      • (K) Game Termination and Prize Claim Period

        • (1) The Company may at any time announce the termination date for an individual Draw-Based Game. If this occurs, no Plays in the relevant game will be sold after the termination date.
        • (2) Subject to Rules 4(K)(4), 4(L)(2)(a) and 4(L)(2)(b) below, Prizes must be claimed no later than 23.00 hours on the one hundred and eightieth (180th) day after the relevant Draw.
        • (3) If a Prize is claimed in person, any relevant completed Prize Claim Form and sufficient information required to authenticate the Claimant as the holder of the particular Account containing the record of the relevant Play must be received by the Company at any Regional Centre (as appropriate) within the period set out in Rule 4(K)(2).
        • (4) A Prize may be claimed at a Regional Centre by the Claimant presenting any relevant completed Prize Claim Form and sufficient information required to authenticate the Claimant as the holder of the particular Account containing the record of the relevant Play within seven days after the end of the period set out in Rule 4(K)(2) provided that before the end of such period the Claimant shall have contacted the Interactive Contact Centre and notified it of his intention to claim and of his name, address and all such details of the Play as the Company shall reasonably require. For the avoidance of doubt, where a Player contacts the Interactive Contact Centre by telephone, this must be during the Interactive Contact Centre's normal operating hours from time to time (which are currently 8.00 a.m.- 11.00 p.m. daily, excluding Christmas Day). Where a Player contacts the Interactive Contact Centre by email, the email must be received by the Company before 11.00pm on the last day of the period set out in Rule 4(K)(2). If the Claimant fails to claim within the said seven days, the Prize will be forfeited and will be transferred to the National Lottery Distribution Fund.
        • (5) Any Prize not claimed within the period set out in Rule 4(K)(2) will be forfeited and the relevant Prize will be transferred to the National Lottery Distribution Fund.
      • (L) Prize Payment

        • (1) Each Player's eligibility to win a Prize is subject to the Play Validation Requirements.
        • (2) Subject to Rule 4(L)(1) above and the other provisions of these Rules:
          • (a) A Low Tier Prize will be placed directly into a Player's Account after the relevant Draw.
          • (b)
            • (i) Subject to Rule 4(L)(2)(b)(ii) below, a Player may direct the Company at any time before 23.00 hours on the one hundred and eightieth (180th) day after the relevant Draw to place a Medium Tier Prize into the relevant Player's bank (or building society) account via the debit card details which are held by the Company on the Interactive System in respect of that Player.
            • (ii) If a Player does not so direct the Company before the sixtieth (60th) day after the relevant Draw, the Company will place such Medium Tier Prize directly into the relevant Player's bank (or building society) account, via the debit card details which are held by the Company on the Interactive System in respect of the Player, sixty (60) days after the relevant Draw. If the Company is unable to so place such Medium Tier Prize directly into the Player's bank (or building society) account, the Company will attempt to invite the Player to claim his prize before the expiry of the 180 day period referred to in Rule 4(L)(2)(b)(i) above by contacting the Player. The methods used by the Company to contact the Player shall be each of e-mail, first class post, and the telephone. To contact the Player, the Company will use the details that are held by the Company on the Interactive System in respect of that Player.
          • (c) A Player will need to claim a High Tier Prize by contacting the Interactive Contact Centre and quoting the Ticket Number. Claims for High Tier Prizes of more than £50,000 must be made in person and shall be paid at the Player's home, other agreed location or at a Regional Centre. The Company reserves the right, at its reasonable discretion, to require claims for High Tier Prizes of or worth between £5,000 and £50,000 to be made in person and for such Prizes to be paid at a Regional Centre.
        • (3) In the event that a single Play contains multiple winning Plays, the Interactive Prize amounts shall be added together for the purpose of calculating the total Interactive Prize payment amount for the relevant Play and shall be paid in accordance with the Interactive Prize payment arrangement specified above.
      • (M) Use of Prize Claim Forms

        • (1) Notwithstanding the provisions of Rule 4(L)(2) above, the Company requires the completion of a Prize Claim Form for any High Tier Prize and any Direct Debit Prize winnings of over £50,000 and reserves the right, at its reasonable discretion, to require the completion of a Prize Claim Form for Low Tier Prizes, Medium Tier Prizes and Direct Debit Prizes. Prize Claim Forms are available from the Interactive Contact Centre.
        • (2) A Prize Claim Form must be completed in the name of, and signed by, the holder of the relevant Account and be accompanied by such Identification Information as is required by the Company to prove that they are the sole holder of the Account containing the record of the relevant Valid Winning Play. However, the Company may exceptionally and at its sole discretion, waive the requirement in respect of a Prize Claim Form for a particular Prize claim, such waiver to be in writing and subject to such terms and conditions as the Company shall require.
        • (3) The Company may refuse to process for payment any Prize Claim Form which is incomplete.
        • (4) If a Claimant is unable to complete a Prize Claim Form due to legal, physical or other disability, a duly authorised representative of the Claimant may complete and sign a Prize Claim Form on his behalf. The Prize Claim Form must state the name of the Claimant and the representative and describe the status of the signatory, if not the Claimant. The Company reserves the right to request evidence of the capacity of a representative to claim.
        • (5) If the person signing the Prize Claim Form is a personal representative of the estate of a deceased winner, that person shall submit with the Prize Claim Form letters of administration or grant of probate showing that appointment or such other documentation as the Company shall in its discretion deem sufficient properly to establish such representative's entitlement to receive the relevant Prize or Prizes.
        • (6) Payment of the Prize to the person shown on the Prize Claim Form as the Claimant or his duly authorised representative shall fully and effectively discharge the Company, its officers, employees, representatives, contractors and any person, firm or company authorised by the Company to pay Prizes from any further liability for payment of that Prize.
        • (7) A person who signs a Prize Claim Form shall be deemed to have represented that he is lawfully entitled to the prize and that the information contained therein is accurate and complete, and shall indemnify the Company against any costs, losses, damages and expenses which the Company may suffer or incur with respect to the Play or delivery of the Prize as a result of any misrepresentation.
        • (8) In the event of any inconsistency in the information submitted on the Prize Claim Form and/or shown on the Account or for any other reason at its absolute discretion, the Company may investigate and withhold all winnings which may be due to the Claimant (or may make a payment into court) until such time as the Claimant satisfies the Company that he is the proper person to whom the Prize should be paid.
      • (N) Payment to Prize Winners in Person and/or by Mail

        • (1) The Company reserves the right to make payment of Prizes to Players by cheque or other approved instrument. In this event, Interactive Prizes of £50,000 or less and Direct Debit Prizes of £5,000 or more up to and including £50,000 will be posted (at the Player's risk in accordance with the Company's procedures) to the Player's address as stored in the Interactive System or as otherwise agreed between the Company and the Player. The Company also reserves the right at its discretion to require a Player to attend at a Regional Centre to claim their Interactive Prize.
        • (2) The Player is responsible, where applicable, for claiming a Prize and the protection of the Identification Information that enables the payment of a Prize.
        • (3) The Company shall not be responsible or liable to any person claiming a Prize which has been paid to a person who assumed the identity of the holder of the relevant Account and who obtained sufficient information about them to impersonate the rightful holder of that Account.
        • (4) Under no circumstances will a purchase confirmation made available to the Player by the Company or sent from the Company to the Player be evidence that a Player is entitled to a Prize.
        • (5) In the event that the Company, in its absolute discretion, believes that the Claimant is not lawfully entitled to payment of a Prize or that a Prize has been paid to a Player (including, without limitation, by payment into a Player's Account in circumstances where the Company decides, in accordance with Rule 5(D)(3) below) that the Claimed Play is invalid or defective, it shall be entitled to withhold payment of the Prize or recover or seek to recover a Prize already paid (including, without limitation, where such payment has been made into a Player's Account) pending the outcome of all appropriate checks and enquiries. Once the appropriate checks and enquiries have satisfied the Company, in its absolute discretion, that the Claimant is lawfully entitled to payment of the relevant Prize, it shall credit the amount of such Prize to the Player's Account.
      • (O) Payment to Persons Under a Legal Disability

        • (1) The Company will make payment to the duly authorised representative of a person under legal or other disability.
        • (2) The Company may apply to a court of competent jurisdiction to determine the lawful payee in any particular case.
        • (3) Save as provided in Rule 4(O)(1), the right of any person to a Prize shall not be assignable.

        • (a) receive, access or transmit any content which is obscene, pornographic, threatening, racist, menacing, offensive, defamatory, in breach of confidence, in breach of any intellectual property right (including, without limit, copyright) or otherwise objectionable or unlawful; or
        • (b) knowingly or recklessly transmit any content (including, without limit, viruses) through the Site and/or the Interactive System which shall cause, or be likely to cause, detriment or harm, in any degree, to computer systems owned by the Company or others; or
        • (c) hack into, make excessive traffic demands on or cause any impairment of the functions of any computer system, deliver or forward chain letters, "junk mail" of any kind, surveys, contests, pyramid schemes or otherwise engage in any behaviour intended to inhibit others from playing the Draw-Based Games Played Interactively or using the Interactive System and/or the Site or any other website, or which is otherwise likely to damage the reputation or business of the Company or of any third party.
      • (2) Each Player agrees to indemnify the Company against any costs, losses, damages and expenses which the Company may suffer or incur arising out of or in relation to any claim, legal proceeding or demand made by any third party due to or arising out of use a Player's wrongful or negligent use of his Account, playing of the Draw-Based Games Played Interactively, access to the Site and/or the Interactive System, or breach by that Player of these Rules.
    • (C) General

      • (1) Any person who purchases a Play or submits a Play for validation or who claims a Prize in whatever capacity, agrees to be bound by the provisions of any applicable legislation, the provisions of these Rules, the Privacy Policy, the Terms and Conditions, the Game Procedures (all of which may be amended from time to time) and any other statements or explanations issued from time to time by the Company in respect of the relevant Draw-Based Game Played Interactively.

      • (3) References to statutory provisions shall be construed as references to those provisions as respectively replaced, amended or re-enacted from time to time and shall include any provisions of which they are re-enactments (whether with or without modification) and any subordinate legislation made under such provisions.
      • (4) Where the context so requires, in these Rules, the neuter gender shall include the feminine or masculine gender and vice versa, the feminine gender shall include the masculine gender and vice-versa and the singular shall include the plural and vice-versa.
      • (5) The invalidity or unenforceability of any term of, or any right arising pursuant to, these Rules shall not affect the validity or enforceability of the remaining terms or rights.
      • (6) Players may not assign or otherwise transfer (in whole or in part) their obligations under these Rules. Any breach of the prohibition on assignment or transfer may result in the use of a Player's Account, the provision of the Draw-Based Games Played Interactively and/or access to the Interactive System being terminated by the Company forthwith. The Company may assign or otherwise transfer these Rules in whole or in part to any third party at its sole discretion.
      • (7) The Commission is an intended beneficiary of these Rules and may enforce any of these Rules under the terms of the Contracts (Rights of Third Parties) Act 1999.
      • (8) Except in the case of any assignment or transfer of these Rules by the Company or as set out in Rule 5(C)(7) above, a person who is not a party to these Rules has no rights under the Contracts (Rights of Third Parties) Act 1999 or otherwise to enforce any provision of these Rules.
      • (9) Each Player agrees that when he contacts the Interactive Contact Centre, he will supply any Games-Related Information required by the Company.

No adjustment will be made to Prizes in the relevant Prize Category(s) as defined in the relevant Game Procedures. For this Rule only in the event of any ambiguity or inconsistency between these Rules and the relevant Game Procedures, this Rule shall prevail.
    • (D) Liability

      • (1) Nothing in these Rules shall exclude or limit any person's liability (a) for fraud; (b) for death or personal injury caused by its negligence (as defined in section 1 of the Unfair Contract Terms Act 1977); (c) for any breach of the terms implied by section 12 Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982; or (d) for which it is not lawfully permitted to exclude or limit.

      • (3) Where instructed by the Commission, the Company shall, or in its discretion acting reasonably, the Company may declare that a Play or a Claimed Play is defective. In such circumstances, all relevant Plays and all relevant Prizes won shall be void and the Company shall either:
        • (a) give the affected Player an opportunity to play another Play of equivalent price; or
        • (b) refund to the affected Player the sums paid by that Player in purchasing the defective Play or Claimed Play.

        The Company may decide which of (a) or (b) above shall apply.

        Players do not have the right to cancel a Play and save as provided in Rule 5(D)(3)(b) no refunds will be given in any circumstances.

      • (4) If the Company shall determine to its entire satisfaction after due and careful enquiry by it that the cancellation of a Play was wholly and directly the result of fraud, negligence or error by the Company then, if such Play would, but for that cancellation, have been a Valid Winning Play, the Company shall not reimburse the cost of the Play and the Company's only liability shall be to pay an amount equal to that Prize to the person who would have been entitled to that Prize under these Rules but for such cancellation.
      • (5) Without prejudice to Rules 5(D)(1) and 5(D)(3) above, the Company shall not in any circumstances be liable for any loss of whatever nature, including, without limitation, loss of profits, indirect, special or consequential loss, suffered or incurred by any Player, any holder or owner of a Play, any Claimant or any other person arising from the withdrawal of any Draw-Based Game or from the participation or non-participation of any person in any Draw-Based Game, including the loss, for whatever reason, of the chance to participate in such Draw-Based Game. In particular, but without prejudice to the generality of the foregoing, the Company shall not be liable to any person:
        • (a) for any event beyond the Company's reasonable control including, but without limitation, any act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest, power cut and/or failure or obstruction of any network, broadcasting or telecommunications service;
        • (b) for the failure of, or damage or destruction to, or any errors caused by the computer systems or records of the Company or any third party (including, without limitation, the Site, the Interactive System and/or the Central Computer System), or any part of any of the foregoing;
        • (c) for delays, losses, errors or omissions in or made by the postal or other delivery service or by the banking system;
        • (d) for any other action or event which prevents or hinders the issue of a valid Play (including without limitation the failure of the Site to display correctly on any device used to view the Site);
        • (e) for the refusal to sell a Play to any person or to allow any person to play a Draw-Based Game Played Interactively or to allow a Direct Debit to be set up or Direct Debit Details to be amended on the Mobile Site;
        • (f) for any losses caused to Players including misuse or unauthorised use of passwords, money lost by playing the Draw-Based Games Played Interactively and failure or malfunction of the equipment or technology of the relevant Player or his internet service provider or mobile phone network operator.
    • (E) Decisions of the Company Binding

      • (1) The Company's decision as to whether or not a Play is a Valid Winning Play or in respect of any other matter or dispute arising from the payment or awarding or non-payment or non-awarding of Prizes shall be final and binding upon all Players and any other person or persons having any interest in the matter or dispute.
      • (2) Without prejudice to Rule 5(D)(3) and Clause 6(F)(3) of the Terms and Conditions, following any decision made by the Company pursuant to Rule 5(E)(1), the Company may, solely at its option, reimburse the cost of the Play or replace the disputed Play with a Play of equivalent sales price for any current Draw-Based Game. This shall be the Player's sole and exclusive remedy, and such reimbursement or replacement shall fully discharge the Company from any liability in respect of such a dispute. The Company may withhold payment of a Prize and/or make an equivalent payment into court until any dispute has been resolved.
    • (F) Law

      These Rules and the rights and obligations of the Company and Players set out herein shall be governed by and construed in all respects in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

          • (ii) If a Player does not so direct the Company before the sixtieth (60th) day after the day on which the relevant Play was purchased, the Company will place such Medium Tier Prize directly into the relevant Player's bank (or building society) account, via the debit card details which are held by the Company on the Interactive System in respect of the Player, sixty (60) days after the relevant Play was purchased. Claims for High Tier Prizes of or worth more than £50,000 must be made in person and shall be paid at the Claimant's home, other agreed location or at a Regional Centre. The Company reserves the right, at its reasonable discretion, to require claims for High Tier Prizes of or worth between £5,000 and £50,000 to be made in person and for such Prizes to be paid at a Regional Centre.
      • (3) In the event that a single Play contains multiple winning Plays, the Prize amounts shall be added together for the purpose of calculating the total Prize payment amount for the relevant Play and shall be paid in accordance with the Prize payment arrangement specified above.
    • (N) Use of Prize Claim Forms

      • (1) Notwithstanding the provisions of Rule 4(M)(2) above, the Company requires the completion of a Prize Claim Form for any High Tier Prize and reserves the right, at its reasonable discretion, to require the completion of a Prize Claim Form for any other Prizes.
      • (3) The Company may refuse to process for payment any Prize Claim Form which is incomplete.
      • (4) If a Claimant is unable to complete a Prize Claim Form due to legal, physical or other disability, a duly authorised representative of the Claimant may complete and sign a Prize Claim Form on his/her behalf.
      • (6) Payment of the Prize to the person shown on the Prize Claim Form as the Claimant or his/her duly authorised representative shall fully and effectively discharge the Company, its officers, employees, representatives, contractors and any person, firm or company authorised by the Company to pay Prizes from any further liability for payment of that Prize.
      • (7) A person who signs a Prize Claim Form shall be deemed to have represented that he is lawfully entitled to the winning Prize and that the information contained therein is accurate and complete, and shall indemnify the Company against any costs, losses, damages and expenses which the Company may suffer or incur with respect to the Play or delivery of the Prize as a result of any misrepresentation.
    • (O) Payment to Prize Winners in Person and/or by Mail

      • (1) The Company reserves the right to make payment of Prizes to Players by cheque, other approved instrument or direct credit. In this event, a Prize of £50,000 or less will be posted (at the Player's risk, in accordance with the Company's procedures) to the Player's address as stored in the Interactive System or as otherwise agreed between the Company and the Player. The Company also reserves the right at its discretion to require a Player to attend at a Regional Centre to claim their Prize.
      • (4) In the event that the Company, in its absolute discretion, believes that the Claimant is not lawfully entitled to payment of a Prize or that a Prize has been paid into a Player's Account in circumstances where the Company decides, in accordance with Rule 5(D)(3) below, that the Claimed Play is invalid or the Interactive Instant Win Game is defective, it shall be entitled to withhold payment of the Prize or recover a Prize already paid into a Player's Account (where applicable) pending the outcome of all appropriate checks and enquiries. Once the appropriate checks and enquiries have satisfied the Company, in its absolute discretion, that the Claimant is lawfully entitled to payment of the relevant Prize, it shall credit the amount of such Prize to the Player's Account.
    • (P) Payment to Persons Under a Legal Disability

      • (1) The Company will make payment to the duly authorised representative of a person under legal or other disability.
      • (2) The Company may apply to a court of competent jurisdiction to determine the lawful payee in any particular case.
      • (3) Save as provided in Rule 4(P)(1), the right of any person to a Prize shall not be assignable.
  • 5. Miscellaneous

    • (A) Use of Content

      • (1) For the avoidance of doubt, the Company is the owner or licensee of the copyright, trade marks and other intellectual property rights in, to and in respect of the Site (including, without limitation, its content), and the Interactive Instant Win Games, and Players or Prospective Players acquire no rights therein. Players and Prospective Players acknowledge and agree that they are only permitted to use the Site and play the Interactive Instant Win Games as expressly set out in these Rules, the Terms and Conditions, the applicable Game Procedures and Game Specific Rules or on the Game Details Screen.
      • (2) Players and Prospective Players agree that the Site and the Interactive Instant Win Games are for their own personal, non-commercial use only on a single device capable of accessing the Interactive System (including any device which can access the Internet).
      • (3) Players and Prospective Players may not:
        • (a) copy, disclose, transmit or otherwise make available or remove or alter any material available on the Site;
        • (b) reverse engineer or decompile (whether in whole or in part) any software used in connection with the Site and/or the provision of the Interactive Instant Win Games (except to the extent expressly permitted by applicable law); or
        • (c) remove, obscure or change any copyright, trade mark or other intellectual property right notices contained in any material obtained from the Site or as a result of playing the Interactive Instant Win Games.
    • (B) Warranties and Indemnities

      • (1) Each Player and Prospective Players warrants that they will only use their Account, play the Interactive Instant Win Games and use the Interactive System in accordance with these Rules and in an appropriate and lawful manner and, by way of example, that they shall not in connection with using their Account, playing the Interactive Instant Win Games or using the Interactive System (and shall not authorise or permit any other party to):
        • (a) receive, access or transmit any content which is obscene, pornographic, threatening, racist, menacing, offensive, defamatory, in breach of confidence, in breach of any intellectual property right (including, without limit, copyright) or otherwise objectionable or unlawful; or
        • (b) knowingly or recklessly transmit any content (including, without limit, viruses) through the Interactive System which shall cause, or be likely to cause, detriment or harm, in any degree, to computer systems owned by the Company or others; or
        • (c) hack into, make excessive traffic demands on or cause any impairment of the functions of any computer system, deliver or forward chain letters, "junk mail" of any kind, surveys, contests, pyramid schemes or otherwise engage in any behaviour intended to inhibit others from playing the Interactive Instant Win Games or using the Site or any other website, or which is otherwise likely to damage the reputation or business of the Company or of any third party.
      • (2) Each Player and Prospective Player agrees to indemnify the Company against any costs, losses, damages and expenses which the Company may suffer or incur arising out of or in relation to any claim, legal proceeding or demand made by any third party due to or arising out of use of a Player's or Prospective Player's Account, playing of the Interactive Instant Win Games, access to the Site, or breach by that Player of these Rules.
    • (C) General

      • (1) Any person who purchases a Play or submits a Play for validation or who claims a Prize in whatever capacity, agrees to be bound by the provisions of the Act, any Regulation made thereunder, the provisions of these Rules, the Terms and Conditions, as amended from time to time, the Game Procedures and Game Specific Rules (all of which may be amended from time to time) and any other statements or explanations issued from time to time by the Company in respect of the relevant Interactive Instant Win Game.
      • (2) Each Prize winner is deemed to acknowledge that, if and to the extent that the Company is legally obliged to provide a third party with details of any Prize claimed by or on behalf of, or paid to the Prize winner, the Company shall be entitled to do so.
      • (6) Save as provided in Rule 4(P)(1) Players or Prospective Players may not assign (in whole or in part) their obligations under these Rules. Any breach of the prohibition on assignment may result in the use of a Player's or Prospective Player's Account, the provision of Interactive Instant Win Games and/or access to the Interactive System being terminated by the Company forthwith. The Company may assign these Rules in whole or in part to any third party at its sole discretion.
      • (7) The Commission is an intended beneficiary of these Rules and may enforce any of these Rules under the terms of the Contracts (Rights of Third Parties) Act 1999.
      • (8) Except in the case of any assignment of these Rules by the Company or as set out in Rule 5(C)(7) above, a person who is not a party to these Rules has no rights under the Contracts (Rights of Third Parties) Act 1999 or otherwise to enforce any provision of these Rules.
      • (9) Each Player and Prospective Player's agrees that when he contacts the Interactive Contact Centre, he will supply any Games-Related Information required by the Company.
    • (D) Liability

      • (2) Players and Prospective Players acknowledge and agree that in accepting these Rules they do not rely on, and shall have no remedy in respect of, any statement, representation, warranty or understanding (whether negligently or innocently made) of any person (whether or not such person is a party to these Rules).
      • (3) Where instructed by the Commission, or in appropriate circumstances and in its discretion acting reasonably, the Company shall declare that a Play, Claimed Play or Interactive Instant Win Game is defective. In such circumstances, all relevant Plays of that Interactive Instant Win Game and all relevant Prizes won shall be void and the Company shall either:
        • (a) give the affected Player an opportunity to play another Play of equivalent price; or
        • (b) refund to the affected Player the sums paid by that Player in purchasing the defective Play or Claimed Play.

        The Company may decide which of (a) or (b) above shall apply.

        Players do not have the right to cancel a Play and no refunds will be given in any other circumstances.

      • (5) Without prejudice to Rules 5(D)(1) and 5(D)(3) above, the Company shall not in any circumstances be liable for any loss of whatever nature, including, without limitation, loss of profits, indirect, special or consequential loss, suffered or incurred by any Player any holder or owner of a Play, any Prospective Player, any Claimant or any other person arising from the withdrawal of any Interactive Instant Win Game or from the participation or non-participation of any person in any Interactive Instant Win Game, including the loss, for whatever reason, of the chance to participate in such Interactive Instant Win Game. In particular, but without prejudice to the generality of the foregoing, the Company shall not be liable to any person:
        • (a) for any event beyond the Company's reasonable control including, but without limitation, any act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest, power cut and/or failure or obstruction of any network, broadcasting or telecommunications service;
        • (b) for the failure of, damage or destruction to, or any errors caused by the Company's computer systems or records (including, without limitation, the Interactive System), or any part thereof;
        • (c) for delays, losses, errors or omissions in or made by the postal or other delivery service or by the banking system;
        • (d) for any other action or event which prevents or hinders the issue of a valid Play (including, without limitation, the failure of an Interactive Instant Win Game to display properly or at all on any device it is accessed from due to incompatible technology);
        • (e) for the refusal to sell a Play to any person in accordance with these Rules or to allow any person to play the Interactive Instant Win Games;
        • (f) for any losses caused by Players or Prospective Players including misuse or unauthorised use of Passwords, money lost by playing the Interactive Instant Win Games and failure or malfunction of the equipment or technology of the relevant Player or Prospective Players, or his internet service provider.

      • (2) Without prejudice to Rules 5(D)(3) and Clause 6(F)(3) of the Terms and Conditions, following any decision made by the Company pursuant to Rule 5(E)(1), the Company may, solely at its option, reimburse the cost of the Play or replace the disputed Play with a Play of equivalent sales price for any current Interactive Instant Win Game. This shall be the Player's sole and exclusive remedy, and such reimbursement or replacement shall fully discharge the Company from any liability in respect of such a dispute. The Company may withhold payment of a Prize and/or make an equivalent payment into court until any dispute has been resolved.
    • (F) Law

      These Rules and the rights and obligations of the Company, Prospective Players and Players set out herein shall be governed by and construed in all respects in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
