- (f) any person who is not permitted to play the Interactive Instant Win Games in the jurisdiction in which they are located;
- (g) any person who does not meet the criteria set out in Clause 4(A)(1) of the Terms and Conditions;
- (h) such other persons or category of persons as the Company and the Commission may agree from time to time.
- (2) If, notwithstanding Rule 4(C)(1) above, a Prize is paid to a person not permitted by that Rule to be paid a Prize, such Prize shall be repayable by that person to the Company upon demand.
- (3) The Company may, in its sole discretion, limit the Plays playable by, or refuse to sell Plays to, any person or persons without giving reasons, but which may include circumstances in which, in its view, that person or persons is or are playing in a manner which it deems to be interfering with other Players’ or Prospective Players’ reasonable access to Interactive Instant Win Games. The Company may also, in its sole discretion limit the number of Try Games playable by a Player or Prospective Player. (D) Play Style of an Interactive Instant Win Game
- (1) The Play Style for each Interactive Instant Win Game is that indicated on the Site and in the relevant Game Procedures and the Game Details Screen for that Interactive Instant Win Game.
- (2) No Player shall enter into any agreement for the issue of a Play or Plays (or for the giving of a Prize) otherwise than in accordance with these Rules, the Terms and Conditions and any applicable Game Procedures and/or Game Specific Rules.
(E) Outcome Determination
- (1) In registering to open an Account and play the Interactive Instant Win Games, Players acknowledge that the Interactive Instant Win Games are games of chance, that the outcome of a Play in the case of any of the Interactive Instant Win Games is pre-determined by the Interactive System at the point of purchase of a Play, and that playing the Interactive Instant Win Games does not involve the exercise of any skill or judgment by a Player.
- (2) Players acknowledge that, in the case of the Interactive Instant Win Games, the Interactive System distributes Plays based on the probabilities within the Prize Structure and not from a limited pool or range of Plays. The chances of winning at each Prize level in an Interactive Instant Win Game are exactly the same for each Play in that Interactive Instant Win Game and such chances of winning are not affected by previous Plays or the number of Prizes previously paid in respect of that Interactive Instant Win Game.
- (3) Players and Prospective Players acknowledge that Try Games are games of chance the outcome of which is pre-determined by the Interactive System at the commencement of play and that Try Games do not involve the exercise of any skill or judgement and outcomes are based on probabilities within the Prize Structure and not from a limited pool.

The Game Procedures for each Interactive Instant Win Game shall contain at least the following information:

A Pay to Play Game is considered complete when its outcome status indicates whether or not a Prize has been won. Any Prize won pursuant to this Rule 4(G), and any claims for any such Prize, shall be subject to the provisions relating to Low, Medium and High Tier Prizes (as appropriate) as contained in Rules 4(L) and 4(M) below.
(H) Game Termination
- (1) The Company may at any time announce the closing date for an individual Interactive Instant Win Game.
- (2) Such announcement shall be made by way of notices to be displayed on the Site for the period from the date of the announcement of the date of closing of the Interactive Instant Win Game up to the closing time. Each such notice shall clearly show the name of the relevant Interactive Instant Win Game, its closing date and the date by which the Prize claims in the relevant Interactive Instant Win Game shall be made. The Company may, in exceptional circumstances, close an individual Interactive Instant Win Game without giving prior notice.
- (3) On closure of an Interactive Instant Win Game any Games purchased by a Player but not completed will be played out to completion automatically by the Interactive System.
(I) Release of Information About Winners
Save for the purposes of publicising unclaimed Prizes or as is required by law, the Company may not publicise any details of any Prize winner that might enable that Prize winner to be identified without the prior written consent of that person.
(J) Play Validation Requirements
- (1) Before a Prize may be paid on any Claimed Play, it must be validated according to the Play Validation Requirements. The Company’s decision as to whether or not the Claimed Play is a Valid Winning Play shall be final and binding. Without prejudice
to the generality of the foregoing:
- (a) the Company shall declare a Claimed Play invalid, and accordingly shall not pay any Prize, if:
- (i) the Claimed Play is the result of an act perpetrated by the Claimant or other person which was intended to increase the chances of that Claimant or person winning a Prize in the Interactive Instant Win Game above those enjoyed by other Players of the Interactive Instant Win Game, or to increase that Prize; or
- (ii) the Claimed Play is counterfeit, has been forged in whole or in part or fails to pass the Company’s confidential validation and security tests; or
- (iii) the claim in respect of the Claimed Play is not received by the Company by the deadline set by the Company or within the timescale applicable to the particular Interactive Instant Win Game; or
- (iv) the Play Number of a Claimed Play does not appear on the Company’s official records of Valid Winning Plays or the relevant Prize in relation to the Valid Winning Play with that Play Number has been paid previously; or
- (v) the details associated with the Play Number of a Claimed Play do not match the Company’s official records of that Play Number; or
- (vi) the Company reasonably believes that a Claimed Play was purchased by a member of any of the classes of individuals listed in Rule 4(C)(1).
- (b) the Company may at its discretion declare a Claimed Play invalid and accordingly shall not be obliged to pay any Prize if:
- (i) the Company reasonably believes that the person claiming the Prize is not the holder of the relevant Account or his duly authorised representative or that the information provided by the person claiming the Prize is incomplete or has been altered or tampered with; or
- (ii) the Claimed Play has not been issued or sold by the Company; or
- (iii) the Play Symbols and Captions, Play Number or any other unique feature of the Claimed Play do not correspond precisely with those on the Interactive System in respect of the Interactive Instant Win Game to which the Claimed Play relates and/or the Claimed Play is defective, in whole or in part; or
- (iv) the outcome of a Play as displayed on the Instant Win Game Play Window is inconsistent with the result of that Play as predetermined by the Interactive System; or
- (v) the distribution, frequency or amounts of Prizes materially differ from that set out in the Prize Structure for a particular Interactive Instant Win Game.
- (a) the Company shall declare a Claimed Play invalid, and accordingly shall not pay any Prize, if:
- (2) A Claimant shall be entitled to claim only the Prize(s) for which the Valid Winning Play is eligible and not any other Prize or any otherwise unclaimed Prize in the particular Interactive Instant Win Game.
- (3) The Company reserves the right to withhold payment of any Prize until it is entirely satisfied as to the validity of any Claimed Play and the good faith of the Claimant, and reserves the right to call for proof of entitlement to a Prize (including, without limit, Identification Information, proof of identity and capacity to claim) and to recover a Prize already incorrectly paid into a Player’s Account.
- (4) The Company reserves the right to photograph any Claimant for security purposes.
- (1) Before a Prize may be paid on any Claimed Play, it must be validated according to the Play Validation Requirements. The Company’s decision as to whether or not the Claimed Play is a Valid Winning Play shall be final and binding. Without prejudice
to the generality of the foregoing:
(K) Responsibility for Plays
- (1) Each Player is responsible for the safe custody of any information required to make a claim on a particular Play (including, without limitation, the relevant Play Number). Failure by a Player to produce sufficient Identification Information on claiming a Prize will result in refusal by the Company to pay the Prize.
- (2) Each Player is responsible for claiming and checking that he receives the full value of the Prize to which he is entitled.
(L) Prize Claim Period
- (1) Subject to Rules 4(M)(2)(a) and 4(M)(2)(b) below, Prizes must be claimed no later than 23.00 hours on the one hundred and eightieth (180th) day after the day on which the relevant Play was purchased.
- (2) If a Prize is claimed in person, any relevant completed Prize Claim Form and sufficient information required to authenticate the Claimant as the holder of the particular Account containing the record of the relevant Play must be received by the Company at any Regional Centre within the period set out in Rule 4(L)(1).
- (3) Any Prize not claimed within the period set out in Rule 4(L)(1) will be forfeited and the relevant Prize will be transferred to the National Lottery Distribution Fund or the Olympic Lottery Distribution Fund, as the case may be.
(M) Prize Payment
- (1) Each Player’s eligibility to win a Prize is subject to the Play Validation Requirements.
- (2) Subject to Rule 4(M)(1) above and the other provisions of these Rules:
- (a) A non-cash prize will be made available to the Player in accordance with the applicable Game Specific Rules.
- (b) A Low Tier Prize will be placed directly into a Player’s Account at the conclusion of the relevant Play.
- (c)
- (i) Subject to Rule 4(M)(2)(c)(ii) below, a Player may direct the Company at any time before 23.00 hours on the one hundred and eightieth (180th) day after the day on which the relevant Play was purchased to place a Medium Tier Prize into the relevant Player’s bank (or building society) account via the debit card details which are held by the Company on the Interactive System in respect of that Player.
- (ii) If a Player does not so direct the Company before the sixtieth (60th) day after the day on which the relevant Play was purchased, the Company will place such Medium Tier Prize directly into the relevant Player’s bank (or building society) account, via the debit card details which are held by the Company on the Interactive System in respect of the Player, sixty (60) days after the relevant Play was purchased. If the Company is unable to so place such Medium Tier Prize directly into the Player’s bank (or building society) account, the Company will attempt to invite the Player to claim his prize before the expiry of the 180 day period referred to in Rule 4(M)(2)(c)(i) above by contacting the Player. The methods used by the Company to contact the Player shall be each of email, first class post, and the telephone. To contact the Player, the Company will use the details that are held by the Company on the Interactive System in respect of that Player.
- (iii) A Player will need to claim a High Tier Prize by contacting the Interactive Contact Centre and quoting the Play Number. Claims for High Tier Prizes of or worth more than £50,000 must be made in person and shall be paid only at a Regional Centre. The Company reserves the right, at its reasonable discretion, to require claims for High Tier Prizes of or worth between £5,000 and £50,000 to be made in person and for such prizes to be paid at a Regional Centre.
- (3) In the event that a single Play contains multiple winning Plays, the Prize amounts shall be added together for the purpose of calculating the total Prize payment amount for the relevant Play and shall be paid in accordance with the Prize payment arrangement specified above.
(N) Use of Prize Claim Forms
- (1) Notwithstanding the provisions of Rule 4(M)(2) above, the Company requires the completion of a Prize Claim Form for any High Tier Prize and reserves the right, at its reasonable discretion, to require the completion of a Prize Claim Form for Low Tier Prizes and Medium Tier Prizes. Prize Claim Forms are available from the Interactive Contact Centre.
- (2) A Prize Claim Form must be completed in the name of, and signed by, the holder of the relevant Account and be accompanied by such Identification Information as is required by the Company to prove that they are the sole holder of the Account containing the record of the relevant Valid Winning Play.
- (3) The Company may refuse to process for payment any Prize Claim Form which is incomplete.
- (4) If a Claimant is unable to complete a Prize Claim Form due to legal, physical or other disability, a duly authorised representative of the Claimant may complete and sign a Prize Claim Form on his/her behalf. The Prize Claim Form must state the name of the Claimant and the representative and describe the status of the signatory, if not the Claimant. The Company reserves the right to request evidence of the capacity of a representative to claim.
- (5) If the person signing the Prize Claim Form is a personal representative of the estate of a deceased winner, that person shall submit with the Prize Claim Form letters of administration or grant of probate showing that appointment or such other documentation as the Company shall in its discretion deem sufficient properly to establish such representative’s entitlement to receive the relevant Prize or Prizes.
- (6) Payment of the Prize to the person shown on the Prize Claim Form as the Claimant or his/her duly authorised representative shall fully and effectively discharge the Company, its officers, employees, representatives, contractors and any person, firm or company authorised by the Company to pay Prizes from any further liability for payment of that Prize.
- (7) A person who signs a Prize Claim Form shall be deemed to have represented that he is lawfully entitled to the winning Prize and that the information contained therein is accurate and complete, and shall indemnify the Company against any costs, losses, damages and expenses which the Company may suffer or incur with respect to the Play or delivery of the Prize as a result of any misrepresentation.
- (8) In the event of any inconsistency in the information submitted on the Prize Claim Form and/or shown on the Account or for any other reason at its absolute discretion, the Company may investigate and withhold all winnings which may be due to the Claimant (or may make a payment into court) until such time as the Claimant satisfies the Company that he is the proper person to whom the Prize should be paid.
(O) Payment to Prize Winners in Person and/or by Mail
- (1) The Company reserves the right to make payment of Prizes to Players by cheque or other approved instrument. In this event, a Prize of £50,000 or less will be posted (at the Player’s risk, in accordance with the Company’s procedures) to the Player’s address as stored in the Interactive System or as otherwise agreed between the Company and the Player. The Company also reserves the right at its discretion to require a Player to attend at a Regional Centre to claim their Prize.
- (2) The Player is responsible, where applicable, for claiming a Prize and the protection of the Identification Information that enables the payment of a Prize.
- (3) The Company shall not be responsible or liable to any person claiming a Prize which has been paid to a person who assumed the identity of the holder of the relevant Account and who obtained sufficient information about them to impersonate the rightful holder of that Account.
- (4) In the event that the Company, in its absolute discretion, believes that the Claimant is not lawfully entitled to payment of a Prize or that a Prize has been paid into a Player’s Account in circumstances where the Company decides, in accordance with Rule 5(D)(3) below, that the Claimed Play is invalid or the Interactive Instant Win Game is defective, it shall be entitled to withhold payment of the Prize or recover a Prize already paid into a Player’s Account (where applicable) pending the outcome of all appropriate checks and enquiries. Once the appropriate checks and enquiries have satisfied the Company, in its absolute discretion, that the Claimant is lawfully entitled to payment of the relevant Prize, it shall credit the amount of such Prize to the Player’s Account.
(P) Payment to Persons Under a Legal Disability
- (1) The Company will make payment to the duly authorised representative of a person under legal or other disability.
- (2) The Company may apply to a court of competent jurisdiction to determine the lawful payee in any particular case.
- (3) Save as provided in Rule 4(P)(1), the right of any person to a Prize shall not be assignable.
5. Miscellaneous

- (2) Each Player and Prospective Player agrees to indemnify the Company against any costs, losses, damages and expenses which the Company may suffer or incur arising out of or in relation to any claim, legal proceeding or demand made by any third party due to or arising out of use of a Player’s or Prospective Player’s Account, playing of the Interactive Instant Win Games, access to the Site, or breach by that Player of these Rules.

(C) General

- (2) Each Prize winner is deemed to acknowledge that, if and to the extent that the Company is legally obliged to provide a third party with details of any Prize claimed by or on behalf of, or paid to the Prize winner, the Company shall be entitled to do so.
- (3) References to statutory provisions shall be construed as references to those provisions as respectively replaced, amended or re-enacted from time to time and shall include any provisions of which they are re-enactments (whether with or without modification) and any subordinate legislation made under such provisions.

Any breach of the prohibition on assignment may result in the use of a Player’s or Prospective Player’s Account, the provision of Interactive Instant Win Games and/or access to the Interactive System being terminated by the Company forthwith. The Company may assign these Rules in whole or in part to any third party at its sole discretion.

The Company may decide which of (a) or (b) above shall apply.
Players do not have the right to cancel a Play and no refunds will be given in any circumstances.
- (4) If the Company shall determine to its entire satisfaction after due and careful enquiry by it that the cancellation of a Play was wholly and directly the result of fraud, negligence or error by the Company then, if such Play would, but for that cancellation, have been a Valid Winning Play, the Company shall not reimburse the cost of the Play and the Company’s only liability shall be to pay an amount equal to that Prize to the person who would have been entitled to that Prize under these Rules but for such cancellation.
