Game Specific Rules for the Set For Life Top and Second Tier Prizes

2nd Edition Effective 1st February 2024

These Game Specific Rules apply when You play Set For Life (the “Game”) in addition to the following documents (depending on how You play):

These Game Specific Rules deal with the payment and award of the Top Prize and the Second Tier Prize in the Game. For information about the Game (including how to play and win) see the relevant Procedures.

If there is any conflict between these documents, the applicable Rules will take priority, followed by these Game Specific Rules, the applicable Procedures and, if You play online, the Account Terms, unless these Game Specific Rules say otherwise.

All words and phrases in these Game Specific Rules that begin with a capital letter and have a specific meaning are explained in Rule 10 in Part 1 and in Rule 6 in Part 2, or in the applicable Rules or Procedures.

PART 1 The Top Prize

1. Claiming Prizes

1.1 In order to claim Your Prize, You must phone the National Lottery Line (if You played at a Retailer) or the Customer Care Team (if You played online) during the Claim Period and in line with the Prize claim procedures and requirements set out in the applicable Rules. Entitlement to the Prize will be lost (and the Prize won’t be paid) if a Prize is not claimed by the deadline set out in the applicable Rules. Prizes must be claimed in person so you will need to arrange an appointment with Allwyn. If You are resident in the UK, the appointment can be at Your home, an Allwyn Regional Centre (see addresses below), or any other location agreed by Allwyn. If You are resident on the Isle of Man, appointments must be at an Allwyn Regional Centre.

1.2 During Your call with the National Lottery Line or Customer Care Team, You will be asked for certain information which may include, without limitation, Your name, date of birth, email address, postal address and telephone number(s) (“Personal Information”) and, if You played at a Retailer, where You bought the relevant Ticket from.

1.3 During Your appointment with the Allwyn representative(s) (the “Validation Meeting”), which the Broker will also attend, You will be asked to complete a Prize Claim Form (provided by Allwyn), or any other form Allwyn requires You to complete, and, if You played at a Retailer, provide the relevant Ticket to the Allwyn representative. You will also need to confirm the Personal Information given under Part 1 Rule 1.2.

2. Payment of Prizes

2.1 Following successful validation of Your claim in the Validation Meeting (in line with the requirements of Rules, Procedures and these Game Specific Rules) the First Prize Payment will be paid to You (by bank transfer or cheque, at Allwyn’s discretion), unless Part 1 Rule 2.7 or Part 1 Rule 6 below applies. Allwyn’s decision about whether the claim is valid will be final and binding.

2.2 Unless Rule 2.7 or Rule 6 in Part 1 applies (and without limiting the effect of Part 1 Rule 5), during the Validation Meeting, You will be required to complete the Annuity Provider’s annuity policy application form (“the Annuity Application”) – this should be done with the Broker attending the Validation Meeting. The Broker will then send the completed Annuity Application and the documents listed in Part 1 Rule 2.3(b) below to the Annuity Provider, and payment will be made by Allwyn to the Annuity Provider for the Annuity Policy Premium. You acknowledge that any delay by You in completing the forms and/or providing the documents referred to above will result in a delay in the Annuity Policy being set up. Allwyn accepts no liability for any Annuity Application and/or other documents being lost or delayed in the post.

2.3 By buying an entry into the Game, You accept that (except when Rule 6 applies) You will be required to:

  • (a) at the relevant time, complete, sign and give to the Broker all documents required including the Annuity Application.
  • (b) give to the Broker for sending to the Annuity Provider Your birth certificate or a copy of Your full passport, all relevant certificates recording any change of name (in place of any original certificate You can provide a copy, certified by the General Registry Office (England and Wales), the General Registry Office (Northern Ireland), the Registrar General (Scotland) or the Civil Registry (Isle of Man) as appropriate); and
  • (c) confirm to Allwyn in writing that guidance about the Annuity Policy has been received from the Broker.

2.4 You also accept and understand that:

  • (a) the Annuity Policy will be a contract between You and the Annuity Provider;
  • (b) Allwyn has no liability of any nature in respect of the payment, non-payment or late payment of any or all Annuity Payments (or Capped Annuity Payments, if relevant); and
  • (c) Allwyn has no liability of any nature for any guidance (or, at Your request, advice) given to You by the Broker or for any loss of any nature including, but not limited to, indirect or consequential loss, suffered or incurred by You as a result of receiving such guidance or advice.

2.5 Allwyn will try to ensure the Annuity Policy is in place within four weeks from the Validation Meeting. However, Allwyn will not be liable in any way for any delay in setting up an Annuity Policy or for any loss of any nature suffered by You as a result of such delay, including without limitation where such delay is a result of a delay by You in completing the form(s) and/or providing the documents referred to above.

2.6 Once the Annuity Policy has been set up it cannot be changed, surrendered or cashed-in.

2.7 If a claim for a Prize is made by a deceased Player’s personal representative and the claim is accepted by Allwyn in line with these Game Specific Rules, the Prize will be the amount Allwyn would have had to pay to set up an annuity policy for the deceased Player, plus the First Prize Payment. Allwyn will pay this amount to the deceased Player’s personal representatives.

3. Tax

The Annuity Payments (and Capped Annuity Payments) comprise of a capital and interest element. The capital element is tax free and the interest element is subject to applicable tax. The amount of tax You will pay will depend on Your circumstances. However, based on the tax rules and rates as at 12th October 2023, the Annuity Payments will not be less than £10,000 after tax (subject to capping). You should contact Your local Her Majesty’s Revenue and Customs Tax Office (HMRC) for more information. Allwyn recommends that You take independent financial advice in relation to the Prize and associated tax consequences.

4. Annuity Policy Features

The Annuity Policy will include premium protection. This means that if You die before the end of the Annuity Payment Period, the Annuity Provider will pay Your estate a lump sum equal to the Annuity Policy Premium less the total of the gross Annuity Payments (or Capped Annuity Payments, if relevant) made until the time the Annuity Provider is notified of Your death.

5. Non-residents of the United Kingdom and Isle of Man

If You are not resident in the United Kingdom or the Isle of Man on the date You complete or would otherwise have completed the Annuity Application, You will not be entitled to an Annuity Policy. If requested by Allwyn and/or the Broker, You will provide suitable evidence to establish whether or not You were a resident in the United Kingdom or the Isle of Man at the relevant time, which the Broker will send to the Annuity Provider. Allwyn’s decision is final and binding in any dispute relating to whether or not You are a resident of the United Kingdom or the Isle of Man.

6. Cash Alternative

6.1 If You are not entitled to an Annuity Policy as a result of Rule 5 above, Allwyn will provide a cash alternative to You. The amount of the cash alternative will be the total of the amount Allwyn would have had to pay to set up an annuity policy if You were a resident of the United Kingdom or Isle of Man and had been entitled to an Annuity Policy under these Game Specific Rules, plus the First Prize Payment.

6.2 Subject to any statutory cancellation right You have, and except as otherwise stated in Rule 2.7 or this Rule 6, there is no cash alternative to the Annuity Policy. However, Allwyn reserves the right to pay you a lump sum in the event that Allwyn (or the Broker) is unable to arrange an Annuity Policy for You for reasons out of their control, or if, in its reasonable opinion, Allwyn deems necessary.

7. Prize Capping

7.1 If a Prize is capped in a Draw, You will be entitled to the Capped Prize Amount. You can either notify Allwyn that You wish to take the Capped Prize Amount as a lump sum, or You can instruct Allwyn that You wish to receive the Capped Prize Amount in monthly instalments during the Annuity Payment Period.

7.2 If You decide to receive the Capped Prize Amount in monthly instalments during the Annuity Payment Period, Allwyn will first calculate the value of Your First Capped Prize Payment which will be paid in accordance with Rule 2.1. Allwyn will do this by dividing the Capped Prize Amount by 360 (representing 12 payments every year for 30 years). The result of this calculation will be Your First Capped Prize Payment. In accordance with these Rules, Allwyn will then arrange via the Broker for an Annuity Policy to be put in place for you. Allwyn will pay the Annuity Policy Premium using the money leftover after deducting the First Capped Prize Payment from the Capped Prize Amount.

7.3 The total value of the monthly payments received under the Annuity Policy may be higher than the value of the Capped Prize Amount lump sum. This is due to the nature of the Annuity Policy purchased and the returns on investment over the Annuity Payment Period.

8. Your information

8.1 Allwyn complies with the requirements of all legislation and regulatory requirements in force from time to time relating to the use of personal data. Where Allwyn is acting as data controller, we will process your personal data in accordance with our Privacy Policy available at https://www.national-lottery.co.uk/privacy-policy.

8.2 By buying an entry into the Game, You acknowledge and agree:

  • (a) Allwyn will be required to reveal Your identity and pass some or all of Your Personal Information to a third party in connection with setting up an Annuity Policy (including the Broker). Allwyn will try its best to ensure that the third party keeps Your identity confidential. However, Allwyn cannot guarantee that the third party will treat Your identity as confidential, and is not responsible or liable if this information is released by that third party to others;
  • (b) some or all of Your Personal Information may be processed outside of the European Economic Area (EEA) by the Broker or the Annuity Provider. Where your personal data is transferred outside of the EEA, Allwyn requires that appropriate safeguards are in place; and
  • (c) the Broker is allowed to pass to Allwyn, and Allwyn is allowed to pass to the Gambling Commission, a copy of any quote the Broker has received for an Annuity Policy, and the name of the Annuity Provider for that Annuity Policy.

9. Law

The relevant law for these Game Specific Rules is English law, and any legal proceedings will be heard in the English Courts.

10. Meaning of Words

The following words and terms will have the meanings given to them below when used in these Game Specific Rules (unless the context clearly indicates otherwise).

Allwyn:
Allwyn Entertainment Ltd, a company registered in England and Wales.
Annuity Application:
has the meaning given to it in Part 1 Rule 2.2.
Annuity Payment:
£10,000 after tax (based on tax rules and rates as at 12th October 2023), being one monthly instalment payable under an Annuity Policy for the Annuity Payment Period. “Annuity Payments” shall be interpreted accordingly.
Annuity Payment Period:
the period starting on the First Annuity Payment Date (after the First Prize Payment has been made) and ending either after 359 Annuity Payments (or Capped Annuity Payments, if relevant) have been made (being one Annuity Payment, or Capped Annuity Payment, per month for 29 years and 11 months) or, if applicable, following payment to a deceased Player’s estate under Part 1 Rule 4.
Annuity Policy:
the policy schedule, policy provisions and other documents which make up a lifetime annuity policy. The Annuity Policy will be established by the Annuity Provider for a period of 29 years and 11 months, in line with these Game Specific Rules.
Annuity Policy Premium:
the amount paid by Allwyn to the Annuity Provider for the Annuity Policy.
Annuity Provider:
a company authorised to issue annuities in the United Kingdom or Isle of Man. The Annuity Provider will be one of the annuity providers chosen by the Broker, in line with any criteria specified by Allwyn, and recommended to and accepted by You.
Broker:
Gallagher Risk and Reward Limited (registered no. 3265272) the registered office of which is at The Walbrook Building, 25 Walbrook, London, EC4N 8AW, or any other broker Allwyn chooses to appoint from time to time.
Capped Annuity Payment:
the monthly instalment payable under an Annuity Policy established in line with Part 1 Rule 7.2, for the Annuity Payment Period. “Capped Annuity Payments” shall be interpreted accordingly.
Capped Prize Amount:
the amount calculated by dividing £16million by the number of Winning Set For Life Entries in the Match 5 + Life Ball Prize category in a Draw.
First Annuity Payment Date:
the policy start date as set out in the Annuity Policy.
First Capped Prize Payment:
has the meaning set out in Part 1 Rule 7.2.
First Prize Payment:
the first Prize payment of £10,000 (or the First Capped Prize Payment, if relevant), paid to You in line with Part 1 Rule 2.1.
Payment Date:
the day each month on which an Annuity Payment (or Capped Annuity Payment, if relevant) will be paid, as set out in the Annuity Policy.
Prize:
a prize entitling You to either (a) the First Prize Payment and, during the Annuity Payment Period, the Annuity Payments (or Capped Annuity Payments, if relevant), or (b) if either Part 1 Rule 2.7 or Part 1 Rule 6 above applies, to a lump sum in line with the relevant Rule, subject to the Rules and these Game Specific Rules.
You/Your:
a member of the public who is eligible to buy an entry for the Game, and who buys or otherwise acquires an entry in accordance with these Game Specific Rules, the Procedures and the Rules.

PART 2 The Second Tier Prize

1. Claiming Prizes

1.1 In order to claim Your Prize, You must phone the National Lottery Line (if You played at a Retailer) or the Customer Care Team (if You played online) during the Claim Period and in line with the Prize claim procedures and requirements set out in the applicable Rules. Entitlement to the Prize will be lost (and the Prize won’t be paid) if a Prize is not claimed by the deadline set out in the applicable Rules. Prizes must be claimed in person so you will need to arrange an appointment with Allwyn. If You are resident in the UK, the appointment can be at Your home, an Allwyn Regional Centre (see addresses below), or another location agreed by Allwyn. If You are resident on the Isle of Man, appointments must be at an Allwyn Regional Centre.

1.2 During Your call with the National Lottery Line or Customer Care Team, You will be asked for certain information which may include, without limitation, Your name, date of birth, email address, postal address and telephone number(s) (“Personal Information”) and, if You played at a Retailer, where You bought the relevant Ticket from.

1.3. During Your appointment with the Allwyn representative(s), You will be asked to complete a Prize Claim Form (provided by Allwyn), or any other form Allwyn requires You to complete, and, if You played at a Retailer, provide the relevant Ticket to the Allwyn representative. You will also need to confirm the Personal Information given under Part 2 Rule 1.2.

2. Payment of Prizes

2.1 Once Your claim has been successfully validated in line with requirements of Rules, Procedures and these Game Specific Rules, the First Prize Payment will be paid to You (by bank transfer or cheque, at Allwyn’s discretion), unless Rule 2.5 or Rule 3 below applies. Allwyn’s decision about whether the claim is valid will be final and binding.

2.2 The remainder of the Prize (being eleven Prize Payments) will be paid by monthly standing order to a UK or Isle of Man bank account. You must give Allwyn Your relevant account details and promptly notify Allwyn in writing of any changes to Your account details.

2.3 If Your name, address or bank details change, You will need to provide Allwyn with evidence of these changes.

2.4 Allwyn will not be liable if You suffer any kind of loss as a result of failing to inform, or delaying in informing, Allwyn of any changes mentioned above. Allwyn will also not be liable for any Prize Payments being lost or delayed in the post or banking system. It is Your responsibility to promptly tell Allwyn in writing if You don’t receive a Prize Payment.

2.5 It is possible that a third party will come forward to Allwyn during the Prize Claim Period or the Prize Payment Period, claiming that they are the legal representative of the deceased Player and are therefore entitled to receive the Prize Payment instead of or for the deceased Player (for example as the executor of a deceased Player’s estate). In such cases, Allwyn will suspend further Prize Payments until it can establish who is properly entitled to receive the Prize Payments. Prize Payments for the remaining Prize Payment Period will then be made to the relevant person.

2.6 Allwyn will not be liable to pay interest to You, or any third party mentioned in Part 2 Rule 2.5, if any Prize Payments are suspended.

2.7 Allwyn reserves the right to pay the Prize as a lump sum if it deems necessary in its reasonable opinion.

3. Non-residents of the United Kingdom and Isle of Man

If You are not resident in the United Kingdom or the Isle of Man when claiming the Prize, Allwyn will pay You a one-off lump sum payment of £120,000 less the First Prize Payment paid under Part 2 Rule 2.1 above if this has already been paid by Allwyn. Allwyn’s decision is final and binding in any dispute relating to whether or not You are a resident of the United Kingdom or the Isle of Man.

4. Law

The relevant law for these Rules is English law, and any legal proceedings will be heard in the English Courts.

5. Your information

Allwyn complies with the requirements of all legislation and regulatory requirements in force from time to time relating to the use of personal data. Allwyn:

Capped Prize Amount:
the amount calculated by dividing the Second Tier Capped Prize Amount by twelve.
First Capped Prize Payment:
the first Prize Payment of the Capped Prize Amount.
First Prize Payment:
the first Prize payment of £10,000 (or the First Capped Prize Payment), paid to You in line with Part 2 Rule 2.1.
First Prize Payment Date:
the date on which You are paid the First Prize Payment.
Prize Payment:
the sum of £10,000 or the Capped Prize Amount.
Prize Payment Period:
the period starting on the First Prize Payment Date and ending when a Prize has been paid in full to You, subject to Part 2 Rule 2.5 above.
Prize:
a prize entitling You to £10,000 (or the Capped Prize Amount) either (a) in the form of twelve monthly Prize Payments during the Prize Payment Period or (b) if Rule 2.7 or Rule 3 in Part 2 applies, in the form of a lump sum, subject to the Rules and these Game Specific Rules.
Second Tier Capped Prize Amount:
the amount calculated by dividing £2million by the number of Winning Set For Life Entries in the Match 5 Prize category.
